ՀԷՑ-ի օտարման վերաբերյալ արբիտրաժային վարույթը կրում է բացառապես դատավարական բնույթ․ փաստաբանական թիմ

«Հայաստանի էլեկտրական ցանցերի» օտարման վերաբերյալ արբիտրաժային վարույթն անցնում է Հայաստանի՝ իրավազորության վերաբերյալ առարկությունների քննարկմանը։

2026 թվականի հունիսի 16-ին ՀԷՑ-ի օտարման վերաբերյալ ներդրումային վեճը քննող արբիտրաժի կազմը կայացրել է դատավարական որոշում՝ վարույթը երկու առանձին փուլի բաժանելու մասին։
Առաջին փուլում արբիտրաժը կքննի Հայաստանի կառավարության կողմից ներկայացված՝ իրավազորության վերաբերյալ առարկությունները։ Այս փուլի ավարտից հետո արբիտրաժն կանցնի վեճի ըստ էության քննարկմանը՝ ներառյալ պետության գործողությունների իրավաչափության և ներդրումների օտարման համար պատասխանատվության հարցերը։
Վարույթը փուլերի բաժանելը հաճախ հանդիպող երևույթ է միջազգային ներդրումային այն վեճերում, որոնք առաջացնում են վիճելի հարցերի մեծ քանակ։ Միաժամանակ, ընդունված որոշումը կրում է բացառապես դատավարական բնույթ և չի վկայում այն մասին, որ արբիտրաժը Հայաստանի փաստարկները ճանաչել է հիմնավորված կամ բավարարման ենթակա։
Ընդհակառակը, 2026 թվականի հունիսի 16-ի իր որոշման մեջ արբիտրները ուղղակիորեն նշել են, որ սույն որոշման նպատակների համար արբիտրաժի կազմը պարտավոր չէ ըստ էության որոշում կայացնել նշված առարկությունների վերաբերյալ, ավելին՝ եթե դա աներ, արբիտրաժի կազմը կենթարկվեր հիմնավորված քննադատության այն բանի համար, որ իբր ձեռնամուխ է եղել այդ առարկությունների հիմնավորվածության անիրավաչափ և վաղաժամ գնահատմանը։
Այսպիսով, Հայաստանի կառավարության՝ իրավազորության վերաբերյալ առարկությունների հիմնավորվածության հարցը մնում է բաց և կդառնա առանձին քննարկման առարկա։ Վարույթը բաժանելու մասին որոշումը չի կանխորոշում տվյալ փուլի արդյունքը և չի կարող դիտարկվել որպես պետության իրավական դիրքորոշման հաստատում։
Ընդ որում, Հայաստանի կառավարության խնդրանքով նախաձեռնված վարույթի բաժանումը կարող է հանգեցնել արբիտրաժային վարույթի տևողության և արժեքի էական ավելացման։ Այն դեպքում, եթե արբիտրաժը մերժի իրավազորության վերաբերյալ բոլոր առարկությունները և ըստ էության բավարարի ներդրողի պահանջները, գործի երկփուլ քննարկմամբ պայմանավորված լրացուցիչ ծախսերը կարող են դրվել Հայաստանի վրա։
Ներդրողները շարունակում են միջազգային արբիտրաժում հետամուտ լինել իրենց իրավունքների լիարժեք պաշտպանությանը և վստահ են իրենցից բռնագանձվող/ունեզրկվող ներդրումների հետ կապված ներկայացված պահանջների հիմնավորվածության մեջ։
Անցյալ տարվա հուլիսին կայացված և Հայաստանին ՀԷՑ-ի օտարմանն ուղղված ցանկացած գործողություն արգելող ապահովման միջոցները շարունակում են ուժի մեջ մնալ։ Համապատասխանաբար, ՀԷՑ-ի և նրա բաժնետերերի դեմ Հայաստանի կառավարության ցանկացած նոր անօրինական գործողություն, այդ թվում՝ ընկերության ազգայնացումը, կխախտի այդ միջոցները և կառաջացնի Հայաստանի միջազգային-իրավական պատասխանատվությունը։
