Իշխանությունների ամբիցիաների պատճառով դատական համակարգն է «փուռը գնում»

Իրավական պետության ձևավորման և օրենքի գերակայության ապահովման տեսանկյունից առանցքային նշանակություն ունի արդարադատության համակարգի կատարելագործումը։ Սակայն դատական համակարգի բարելավման փոխարեն մենք տեսնում ենք իշխանության այդ ճյուղի քաղաքականացում և դեգրադացում, որի արդյունքում էլ ճգնաժամային իրավիճակ է ստեղծվել Սահմանադրական արդարադատության բարձրագույն մարմնում՝ Սահմանադրական դատարանում։ Ընդ որում՝ ճգնաժամ ձևովորվել է հենց իշխանությունների ձեռքով: Վերջերս իշխանությունների կողմից առաջ քաշված Սահմանադրության փոփոխության նախագծի ընդունմամբ, որն ըստ մասնագետների՝ իրավական առումով խնդրահարույց էր, դադարեցվեցին 12 տարուց ավելի պաշտոնավարած 3 դատավորների լիազորությունները։ Եվ հիմա իշխանությունները նոր դատավորներ ընտրելու խնդրի առաջ են կանգնած։ Սակայն այս հարցում իշխող ուժն այնպիսի քաղաքականություն է վարում, որ առաջին հերթին հենց իշխանության համակիրներն են դեմ ներկայացված ՍԴ դատավորների թեկնածուներին և այս առիթով մեծ աղմուկ են բարձրացրել՝ կապելով նրանց նախկին իշխանությունների հետ, այսինքն՝ էլի համարելով նախկին: Ստացվում է, որ ներկայիս իշխանություններն այնքան ապաշնորհ են, որ սեփական կադրեր չունեն և ստիպված հույս են կապում միայն հին կադրերի ընտրության հետ։ Ու դրանով ՍԴ-ում կատարվող փոփոխությունների իմաստը դառնում է անհասկանալի։ Չէ՞ որ բոլոր դեպքերում ընտրվելու են այն մարդիկ, ովքեր նախորդ իշխանության հետ են ասոցացվում։ Կամ էլ գործող իշխանություններն այդպիսի թեկնածուներ են առաջ քաշում, որովհետև հաշվի են առնում, որ նախորդ իշխանության կադրերը ամեն դեպքում բարձր պրոֆեսիոնալիզմներ են։ Եթե այդպես է, ապա ի՞նչն է ՍԴ-ում կատարվող փոփոխությունների նպատակը։ Ո՞րն էր, ինչպես ժողովուրդն է ասում, «չեղած տեղից» ճգնաժամ հորինելու, հետո իրապես ճգնաժամ ձևավորելու իմաստը: Տպավորություն է, թե իշխանությունները ՍԴ-ում փոփոխությունների են գնում միայն նրա համար, որ թեկնածուներն ուղղակի իրենց կողմից նշանակված լինեն։ Բայց չէ՞ որ այդ ամբիցիաների պատճառով դատական համակարգն է «փուռը գնում»։
