Մինչդեռ Փաշինյանն իրավունք չունի ներկայիս կարգավիճակում նախարար կամ նախարարի ԺՊ նշանակել, քանի որ ինքն էլ է ԺՊ։ Սահմանադրության 150-րդ հոդվածն ասում է․ «Կառավարությունը կազմավորվում է վարչապետ նշանակվելուց հետո՝ 15-օրյա ժամկետում: Իր նշանակումից հետո վարչապետը 5-օրյա ժամկետում նախագահին առաջարկում է փոխվարչապետների եւ նախարարների թեկնածուներին: Նախագահը եռօրյա ժամկետում կա՛մ նշանակում է փոխվարչապետներին եւ նախարարներին, կա՛մ դիմում է ՍԴ: ՍԴ-ն դիմումը քննում եւ որոշում է կայացնում 5-օրյա ժամկետում: Եթե նախագահը եռօրյա ժամկետում չի կատարում սույն հոդվածով սահմանված պահանջները, ապա համապատասխան փոխվարչապետը կամ նախարարը նշանակված է համարվում իրավունքի ուժով»։

Հավանաբար, ավելի ուշ գիտակցեցին, եւ օրվա վերջին Կարապետյանը նշանակվեց Պնախարարի առաջին տեղակալ։
