«Փաստ» օրաթերթը գրում է.

 Երևան քաղաքի ընդհանուր իրավասության քրեական դատարանի՝ 2026 թվականի նոյեմբերի 5-ի որոշումը, որով «Բարգավաճ Հայաստան» կուսակցության առաջնորդ, ԱԺ նախկին պատգամավոր Գագիկ Ծառուկյանի կալանքի ժամկետը երկարացվեց ևս 3 ամսով, հերթական անգամ ի ցույց դրեց հայաստանյան իրավապահ ու դատական համակարգի խորքային խնդիրները:

Ինչպես դատական որոշման հրապարակումից առաջ լրագրողների հետ զրույցում ընդգծել էր փաստաբան Երեմ Սարգսյանը, մյուս մեղադրյալների վերաբերյալ նմանատիպ ակտերից հետո ակնհայտ էր, որ դատարանը կիրառելու է նույն ձևական ու կանխորոշված մոտեցումը: Չնայած պաշտպանական կողմի հիմնավոր պահանջին՝ կալանքի հարցը քննարկել բացառապես անհատական ու առարկայական հիմքերով, դատական ատյանը իսպառ անտեսեց իրավական այն հիմնարար սկզբունքը, ըստ որի՝ ազատության մեջ մնալու դեպքում քննությանը խոչընդոտելու վտանգի առկայությունը պարտավոր է հիմնավորել մեղադրանքի կողմը կամ մատնանշել դատարանը, այլ ոչ թե պաշտպանությունը ենթադրություններ անի գոյություն չունեցող հիմքերի շուրջ: Սա ոչ այլ ինչ է, քան արդարադատության համակարգի գործիքավորում՝ սեփական ընդդիմախոսներին լռեցնելու և քաղաքական դաշտը միանձնյա վերահսկելու նպատակով: Երբ իշխանության ղեկին գտնվող սուբյեկտի յուրաքանչյուր քմահաճույք վեր է ածվում չգրված օրենքի, իսկ դատական համակարգը վերածվում է սովորական կատարողական մարմնի, իրավունքի գերակայության մասին խոսակցություններն ստանում են զուտ ֆորմալ բնույթ: Այսօրինակ համակարգերում հակաիշխանական հայացքներ ունենալն ու սեփական դիրքորոշումն ապացուցելը բավարար պայման են դառնում, որպեսզի քաղաքական գործիչն ու նրա շուրջ ձևավորված թիմը հայտնվեն տեղեկատվական ու իրավական ճնշումների կենտրոնում:

 Մեխանիզմն աշխատում է պարզունակ, բայց հաստատուն տեխնոլոգիայով. նախ՝ վերահսկելի մեդիառեսուրսների միջոցով գործի է դրվում հանրային վարկաբեկման մեքենան, իսկ այնուհետև՝ անհեթեթ ու շինծու մեղադրանքներով, առանց որևէ իրավական ու բարոյական նշույլի, մարդկանց ամիսներով կամ տարիներով պահում են անազատության մեջ: Կալանքը, որն, ըստ օրենքի տառի ու ոգու, պետք է լինի խիստ բացառիկ ու ծայրահեղ միջոց, վերածվել է պատժիչ գործիքի՝ փաստացի փոխարինելով դատավճռին: Երբ չկան հիմնավոր փաստեր, երբ պաշտպանական կողմը դատարանում հատ առ հատ ջախջախում է առաջադրված վարկածները, իսկ որոշումը միևնույն է մնում է անփոփոխ, դա այլևս իրավաբանություն չէ. դա մեկ անձի քաղաքական կամքի կատարում է:

Այնուամենայնիվ, քաղաքական պատմությունը ցույց է տալիս, որ ընտրովի արդարադատության վրա հենված համակարգերը չափազանց կարճակյաց են: Ճնշումներով ու ապօրինություններով հնարավոր է ժամանակավորապես սահմանափակել մարդու ֆիզիկական ազատությունը, բայց անհնար է լռեցնել քաղաքական գիտակցությունն ու արդարության պահանջը: Ցանկացած անօրինականություն վաղ թե ուշ բախվում է իրականության պատին, իսկ օրենքի գերակայությունը վերականգնվում է այն պահին, երբ քաղաքական պատվերը կորցնում է իր ազդեցությունը:
