Դատարանը մերժել է Ռոբերտ Քոչարյանի հայցը՝ Ալեն Սիմոնյանի արտահայտությունների վերացական և անկապ լինելու պատճառաբանությամբ․ Միկոյան

Օրեր առաջ լուր հրապարակվեց, թե Ալեն Սիմոնյանն առաջին ատյանի դատարանում հաղթել է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին։

Ռոբերտ Քոչարյանի գրասենյակի ղեկավար Բագրատ Միկոյանը Yerevan.Today-ի հետ զրույցում ասաց․ «Դատարանը մերժել է ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի հայցը ոչ թե այն հիմնավորմամբ, որ Ալեն Սիմոնյանի արտահայտությունները եղել են իրավաչափ, հիմնավորված կամ թույլատրելի քաղաքական խոսք, այլ ընդհակառակը՝ այն պատճառաբանությամբ, որ դրանք, ըստ դատարանի, եղել են այն աստիճանի անստույգ, վերացական և անկապ, որ դրանցով չի ապացուցվել Ռոբերտ Քոչարյանի պատիվն ու արժանապատվությունը նպատակաուղղված արատավորելու դիտավորության առկայությունը։
Փաստորեն, դատարանը չի արդարացրել Ալեն Սիմոնյանի հրապարակային խոսքը, այլ դրա իրավական հետևանքների բացակայությունը պայմանավորել է բացառապես այդ խոսքի անորոշ և ոչ հստակ բնույթով։
Ստացվում է, որ քաղաքական բարձր պաշտոն զբաղեցնող անձի կողմից հրապարակային հաղորդակցության գնահատման առանցքում դրվել է ոչ թե խոսքի բովանդակությունը, այլ դրա անորոշության աստիճանը։
Դատարանի այս իրավական մոտեցումը կհանդիսանա վերադաս դատական ատյաններում վերանայման առարկա»։

Հիշեցնենք, Ռոբերտ Քչորյանը դատի էր տվել Ն․ Փաշինյանին և Ա․ Սիմոնյանին։ Վերջինս ֆեյսբուքում անդրադարձել էր իրեն դատի տալուն՝ գրելով․ «Ռոբերտ Քոչարյանն ինձ և Նիկոլ Փաշինյանին դատի է տվել, պատկերացնո՞ւմ եք: Ոչ թե անվտանգության աշխատակիցները տարել են և այնքան ծեծել, որ մահանամ, ոչ թե դիպուկահարներ են եկել և կրակել վրաս, ոչ թե զինված նախկին դաշնակցականներ են ներխուժել ԱԺ դահլիճ և գնդակահարել ինձ, այլ դիմել է դատարան՝ իր բարի համբավը վերականգնելու համար․․․»։ Ապա շարունակել էր գրառումը այլ ընդունակություններով ևս։

Ռոբերտ Քոչարյանը դատի էր տվել Ալեն Սիմոնյանին՝ իր արժանապատվությունն ու բարի համբավը արատավորելու հայցով։ Դատարանը մերժել է Ռոբերտ Քոչարյանի հայցը, սակայն ուշագրավը հենց մերժման հիմնավորումն է։
