Իրավական առումով ծայրահեղ խնդրահարույց նախագիծ՝ առանց կարծիքները հաշվի առնելու

Կորոնավիրուսի համավարակի դեմ պայքարի շրջանակներում հայտարարված արտակարգ դրության իրավական ռեժիմի գործողության պայմաններում «Արտակարգ դրության իրավական ռեժիմի» մասին օրենքով են սահմանված արտակարգ դրության ժամանակ կիրառվող միջոցառումները և իրավունքների ու ազատությունների ժամանակավոր սահմանափակումները։

Սակայն պարզվում է, որ այս օրենքով նախատեսված սահմանափակումներն ու միջոցառումները կառավարության համար բավարար չեն, և կառավարությունը իրավական որոշակիության և միջոցառումների կիրառման սահմանների և ծավալների հստակեցման առումով նպատակահարմար է գտել առավել համապարփակ կարգավորումներ նախատեսել սահմանափակման ենթակա իրավունքների, ազատությունների և կիրառվող միջոցառումների առումով:

Եվ այսպես, ապրիլի 23-ին կառավարության նիստում կառավարությունը չզեկուցվող հարցերի շարքում ընդունեց «Արտակարգ դրության իրավական ռեժիմի» մասին օրենքում փոփոխության նախագծին հավանություն տալու մասին որոշում, որով մեկուսացման ընթացակարգ սահմանելուն զուգահեռ՝ նաև պետական մարմնին բանավոր կարգադրությամբ քաղաքացիներին փաստացի ազատությունից զրկելու հնարավորություն տվեց։

Նախագծի համաձայն՝ անձին ազատությունից զրկել կարող է արտակարգ դրության պայմաններում միջոցառումների իրականացման համար ներգրավված մարմինը՝ դրա մասին անձին բանավոր հայտնելով։

Նախագծի ընդունումը մասնագետների կողմից խնդրահարույց է համարվում։

Նախ` նախագծում հստակեցված չէ, թե կոնկրետ որ պետական մարմնի բանավոր կարգադրությամբ է քաղաքացիներին ազատությունից զրկելու հնարավորություն տրվում և կոնկրետ ինչ սահմանափակումների մասին է խոսքը։

Բացի այդ, նախագծի կիրառումը լուրջ խնդիրներ է ստեղծում։

Օրինակ՝ եթե քաղաքացին հայտարարի, թե իրեն բանավոր հրահանգ չի տրվել պետական մարմնի կողմից, ապա դժվար է լինելու ապացուցել, թե կոնկրետ ո՞ր մարդուն է տրվել այդ հրահանգը կամ բանավոր հրահանգը կոնկրետ ինչ սահմանափակումներ է ներառել։ Այսպիսով՝ բանավոր հրահանգի կատարումը կարող է հարցականի տակ դրվել։

 

Ճիշտ է՝ համաճարակի ժամանակ Սահմանադրությունը թույլ է տալիս մարդու ազատության սահմանափակում: Բայց նույնիսկ այդ պայմաններում Սահմանադրությունը պահանջում է, որպեսզի ապահովվի, օրինակ՝ անձի՝ դատական կարգով բողոքարկման իրավունքը: Սակայն բանավոր կարգադրության դեպքում հարցական է, թե այդ կարգադրությունը ո՞նց է բողոքարկվելու, ո՞նց է ապահովվելու փաստաբանի մասնակցությունն այդ բողոքարկմանը և այլն:

Դրա համար նպատակահարմար է, որ երբ մարդու ազատությունը համաճարակային պայմաններում սահմանափակվում է, ապա դրա մասին առնվազն որոշում պիտի լինի, պետք է սահմանված լինի, թե նա այդ ընթացքում ինչ իրավունքներ ու պարտականություններ ունի։ Ըստ այդմ՝ անհրաժեշտ է, որ հրահանգը լինի գրավոր և իրավական առումով մաքսիմալ որոշակի:

Մասնագետներն արձանագրում են, որ ներկայացված տեսքով նախագիծն ուղղակի հակասահմանադրական է։ Եվ պատահական չէ, որ մասնագետները կոշտ գնահատականներ են հնչեցնում կառավարության կողմից ընդունված նախագծի շուրջ՝ այն համարելով նաև հակամարդկային և մարդու իրավունքների պաշտպանությունից չբխող։

Իսկ այն, որ կառավարության և ԱԺ-ի կողմից նման փնթի, կիսատ-պռատ ու խնդրահարույց նախագծեր են ընդունվում, իշխանությունների մեծամտության արդյունք է, քանի որ նրանք չեն ցանկանում այդ նախագծերը պատշաճ մակարդակով հանրային քննարկման դնել և լսել դրանց շուրջ մասնագետների կարծիքները։
