«Հեծանիվի վրաերթի» գործով Արթուր Ալեքսանյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասի հատկանիշներով, այն բանի համար, որ «Ազգային ժողովի նիստի ավարտից հետո, Արթուր Ալեքսանյանը Երևան քաղաքի Բաղրամյան պողոտայում հետապնդել է իշխանության ներկայացուցիչ հանդիսացող` ՀՀ ազգային ժողովի պատգամավոր Նիկոլայ Բաղդասարյանին, և պարզելով, որ վերջինս կողմ է քվեարկել կոնվենցիայի վավերացմանը, տվել է սեռական բնույթի հայհոյանքներ և սպառնացել հաշվեհարդար տեսնել նրա հետ:»: Այս մասին իր ֆեյսբուքյան էջում գրել է Փաստաբանների պալատի նախագահ Արա Զոհրաբյանը։

Գրառման մեջ, մասնավորապես, ասվում է. «ՔԱՂԱՔԱՑՈՒՆ ԲԱՑԱՀԱՅՏ ԱՆՀԻՄՆ ՄԵՂԱԴՐԱՆՔ Է ԱՌԱՋԱԴՐՎԵԼ ԵՎ ՔԱՂԱՔԱՑԻՆ ԱՅԴ ԱՆՀԻՄՆ ՄԵՂԱԴՐԱՆՔՈՎ ԿԱԼԱՆԱՎՈՐՎԱԾ Է

«Հեծանիվի վրաերթի» գործով Արթուր Ալեքսանյանին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասի հատկանիշներով, այն բանի համար, որ «Ազգային ժողովի նիստի ավարտից հետո, Արթուր Ալեքսանյանը Երևան քաղաքի Բաղրամյան պողոտայում հետապնդել է իշխանության ներկայացուցիչ հանդիսացող` ՀՀ ազգային ժողովի պատգամավոր Նիկոլայ Բաղդասարյանին, և պարզելով, որ վերջինս կողմ է քվեարկել կոնվենցիայի վավերացմանը, տվել է սեռական բնույթի հայհոյանքներ և սպառնացել հաշվեհարդար տեսնել նրա հետ:»:

Ամենևին գնահատական չտալով Արթուր Ալեքսանյանին վերագրվող արարքի բարոյական կողմին, թե արդյո՞ք ընդունելի է պատգամավորին սեռական բնույթի հայհոյանք տալ կամ սպառնալ (եթե այդպիսի բան տեղի է ունեցել), սույն հրապարակմամբ, որպես փաստաբան, ցանկանում եմ իրավաբանական հանրույթի ուշադրությունը հրավիրել մի վտանգավոր երևույթի վրա:

ՔԱՂԱՔԱՑՈՒՆ ԲԱՑԱՀԱՅՏ ԱՆՀԻՄՆ ՄԵՂԱԴՐԱՆՔ Է ԱՌԱՋԱԴՐՎԵԼ ԵՎ ՔԱՂԱՔԱՑԻՆ ԱՅԴ ԱՆՀԻՄՆ ՄԵՂԱԴՐԱՆՔՈՎ ԿԱԼԱՆԱՎՈՐՎԱԾ Է:

ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 3-րդ մասի համաձայն՝ սույն օրենսգրքում ԻՇԽԱՆՈՒԹՅԱՆ ՆԵՐԿԱՅԱՑՈՒՑԻՉ է համարվում պետական և տեղական ինքնակառավարման մարմիններում ծառայող այն անձը, ով ծառայողական ենթակայության տակ չգտնվող անձանց նկատմամբ սահմանված կարգով օժտված է կարգադրիչ լիազորություններով:

Այս նորմից հետևում է, որ անկախ նրանից, թե իրավունքի մյուս ճյուղերում ԻՇԽԱՆՈՒԹՅԱՆ ՆԵՐԿԱՅԱՑՈՒՑԻՉ հասկացությունն ինչ իմաստ է արտահայտում, քրեական օրենսգրքի իմաստով ԻՇԽԱՆՈՒԹՅԱՆ ՆԵՐԿԱՅԱՑՈՒՑԻՉԸ պետական մարմնում ծառայող այն անձն է, որը ծառայողական ենթակայության տակ չգտնվող անձանց նկատմամբ սահմանված կարգով օժտված է կարգադրիչ լիազորություններով:

Սա նշանակում է, որ պետական այն ծառայողի մասին է խոսքը, որը կարող է կատարման ենթակա հանձնարարություններ տալ այլ անձանց, որոնք իր հետ ծառայողական ենթակայության մեջ չեն գտնվում: Օրինակ, վարչարարություն իրականացնող պաշտոնատար անձը քրեական օրենսգրքի իմաստով իշխանության ներկայացուցիչ է:

ՊԱՏԳԱՄԱՎՈՐԸ քրեական օրենսգրքի իմաստով չի կարող հանդիսանալ ԻՇԽԱՆՈՒԹՅԱՆ ՆԵՐԿԱՅԱՑՈՒՑԻՉ, քանի որ չունի կարգադրիչ լիազորություն: Օրինակ՝ պատգամավոր Նիկոլայ Բաղդասարյանը չէր կարող քաղաքացի Արթուր Ալեքսանյանին պարտադիր կատարման ենթակա կարգադրություն կամ հանձնարարություն տալ:

Հետևաբար, Արթուր Ալեքսանյանին չէին կարող վերը նկարագրված դեպքի առնչությամբ ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի 1-ին մասով մեղադրանք առաջադրել և կալանավորել:

Հ.Գ. Եթե այս հայտարարության հետ քրեական հետապնդման մարմինը համաձայն չէ, ապա երկակի ստանդարտներից հեռու մնալու համար նույն կերպ պետք է ՀՀ քրեական օրենսգրքի 316-րդ հոդվածի հատկանիշներով մեղադրանք առաջադրելու հարցը քննարկեր Ազգային ժողովում Էդմոն Մարուքյանի և Սասուն Միքայելյանի միջև տեղի ունեցած վիճաբանության ժամանակ սպառնալիքների մասով:

Հիշեցնեմ, որ ՀՀ քրեական օրենսգրքի 316-րդ հոդվածում նկարագրված արարքի հետ կապված քրեական հետապնդումն իրականացվում է հանրային մեղադրանքի կարգով: Այսինքն անկախ տուժողի բողոքից քրեական հետապնդումը պետք է իրականացվեր»։
