Փաշինյանը նոր դավադրություն է պատրաստում արդարադատության համակարգի դեմ

Նիկոլ Փաշինյանը երեկ հայտարարել է, թե Հայաստանում դատական և արդարադատության ու արդարության համակարգերը հիմնականում չունեն օրգանական կապ իշխանության բարձրագույն աղբյուրի՝ ժողովրդի հետ։ Նրա խոսքով՝ «2018 թվականի հեղափոխությունից հետո ամենամեծ քննադատությունը Հայաստանի կառավարության և քաղաքական մեծամասնության հասցեին այն է, որ նրանք, արդարության ակնկալիքը ունենալով որպես հեղափոխության օրակարգերից մեկը, դեռևս չեն կարողացել Հայաստանում արդարության ոլորտում հասնել այնպիսի հաջողությունների, որ կգնահատվի լավ կամ բավարար»։

«Այսօրվա համակարգի պայմաններում մենք երբեք արդարություն և արդարադատության զգացում չենք ունենալու, որովհետև ես մեր գործընկերներին ասել եմ, որ Հայաստանում դատական և արդարադատության ու արդարության համակարգերը հիմնականում չունեն օրգանական կապ իշխանության բարձրագույն աղբյուրի՝ ժողովրդի հետ։ Եվ այս խնդիրն է կարևորագույններից մեկը, որը մենք պետք է լուծենք՝ առաջիկայում նոր Սահմանադրություն ընդունելով։ Որովհետև Հայաստանում արդարադատությունը և արդարությունը կառավարվում են մեծ մասամբ այնպիսի ինստիտուտների կողմից, որոնք կղզիացած են, մեկուսացած են, չունեն օրգանական կապ ժողովրդի հետ, չունեն հաշվետվողականության և պատասխանատվության բավարար մակարդակ ժողովրդի առաջ, որը իշխանության բարձրագույն կրողն է»,- նշել է նա։

2018 թվականի իշխանափոխությունից հետո Փաշինյանն ամեն գնով ցանկացել է արդարադատության համակարգը խեղաթյուրել, դարձնել իր խամաճիկը, որպեսզի դատարանները կատարեն իր բոլոր հրահանգները։ Մեծ հաշվով, այս փորձը հաջողվել է մասամբ, քանի որ շատ անկախ դատավորների պարզապես հեռացրել են, Սահմանադրական դատարանը վերածել են խամաճիկ կառույցի, որտեղ այլևս ըմբոստության և դիմադրության օջախներ չկան, բայց դեռևս դատական համակարգում կան դատավորներ, որոնք հրաժարվում են կատարել գործող իշխանությունների պահանջները։

Փաշինյանի՝ խորհրդարանում արած հայտարարությունից կարելի է եզրակացնել, որ նոր Սահմանադրության մեջ այնպիսի մշակումներ են իրականացնում, որպեսզի ընդհանրապես արդարադատության համակարգը վերածվի գործող իշխանությունների հլու կամակատարի, իսկ ըմբոստ դատավորներին հնարավոր լինի հեռացնել գործադիր իշխանության ղեկավարի մեկ քմահաճույքով։ Սա է, որ պետք է հենց մտահոգի առաջին հերթին թե՛ հայ հասարակությանը և ընդդիմությանը, և թե՛ Փաշինյանի միջազգային գործընկերներին։
