Թմրամիջոցների ապօրինի շրջանառության դեպքի առթիվ քննվող քրեական գործով 2 անձ կալանավորվել է. ՔԿ

2020թ. սեպտեմբերի 1-ին` ժամը 18:10-ին, ապօրինի թմրանյութ պահելու, իրացնելու և օգտագործելու կասկածանքով, Երևան քաղաքի Չեխովի փողոցից ոստիկանության Շենգավիթի բաժին բերման է ենթարկել 57-ամյա տղամարդ, ում անձնական խուզարկությամբ հայտնաբերվել է երկու փայլաթիթեղի մեջ փաթեթավորված շագանակագույն՝ «Հերոին» տեսակի, թմրամիջոցին նմանվող զանգվածներ: Փաթեթների քաշը կազմել է մոտ 0,6 գրամ:

2020թ. սեպտեմբերի 2-ին՝ ժամը 14:10-ին, ապօրինի թմրանյութ պահելու, իրացնելու և օգտագործելու կասկածանքով Երևան քաղաքի Ն.Շենգավիթ 13 փողոցից ՀՀ ոստիկանության Շենգավիթի բաժին բերման են ենթարկվել երկու քաղաքացի: Նրանցից մեկի՝ 55-ամյա տղամարդուն պատկանող «Օպել» մակնիշի ավտոմեքենայի խուզարկությամբ հայտնաբերվել է երկու փայլաթիթեղի մեջ փաթեթավորված շագանակագույն` «Հերոին» տեսակի թմրամիջոցին նմանվող զանգվածներ: Փաթեթների քաշը կազմել է մոտ 0,9 գրամ:

Փաստերի առթիվ ՀՀ ոստիկանության Շենգավիթի բաժնում ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի 2-րդ մասի 2-րդ կետով և 268-րդ հոդվածի 2-րդ մասի 2-րդ կետով հարուցվել են քրեական գործեր, որոնք նախաքննություն կատարելու համար ստացվել են ՀՀ քննչական կոմիտեի Շենգավիթ վարչական շրջանի քննչական բաժին և ընդունվել վարույթ:

Նախաքննության ընթացքում կատարված քննչական և օպերատիվ-հետախուզական միջոցառումների արդյունքում պարզվել է, որ նշված անձինք թմրամիջոցը ձեռք են բերել միևնույն անձից՝ Երևան քաղաքի 61-ամյա բնակչից:

Որոշում է կայացվել նշված քրեական գործերը միացնելու և նախաքննությունը մեկ վարույթում շարունակելու մասին:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 61-ամյա տղամարդուն մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 266-րդ հոդվածի (թմրամիջոցների, հոգեմետ (հոգեներգործուն) նյութերի և դրանց պրեկուրսորների ապօրինի շրջանառությունն իրացնելու կամ պատրաստելու նպատակով կամ դրանց ապօրինի իրացնելը) 2-րդ մասի 2-րդ կետով (2 դրվագ), իսկ 55-ամյա տղամարդուն՝ ՀՀ քրեական օրենսգրքի 268-րդ հոդվածի (թմրամիջոցների կամ հոգեմետ (հոգեներգործուն) նյութերի ապօրինի շրջանառությունն առանց իրացնելու նպատակի) 2-րդ մասի 2-րդ կետով: Նրանց նկատմամբ որպես խափանման միջոց կիրառվել է կալանավորումը:

Որոշում է կայացվել 57-ամյա տղամարդուն, որին մեղադրանք էր առաջադրվել ՀՀ քրեական օրենսգրքի 268-րդ հոդվածի 2-րդ մասի 2-րդ կետով, ազատել արգելանքից՝ անհրաժեշտությունը վերանալու հիմքով: Նրա նկատմամբ որպես խափանման միջոց ընտրվել է ստորագրություն՝ չհեռանալու մասին:
