Դատարանը հաստատել է Սամվել Կարապետյանի ձերբակալման ապօրինի լինելու փաստը

Հայաստանի վերաքննիչ քրեական դատարանը ոչ իրավաչափ է ճանաչել Սամվել Կարապետյանի ձերբակալումը։ Նրա փաստաբանի խոսքով, դատարանը հաստատել է, որ հունիսի 18-ին Սամվել Կարապետյանի ձերբակալությունը եղել է ոչ իրավաչափ, ինչի արդյունքում Սամվել Կարապետյանը ապօրինաբար՝ շուրջ 9 և ավելի ժամ, պահվել է անազատության մեջ։ Ավելի վաղ ՀՀ վերաքննիչ քրեական դատարանը արձանագրել էր, որ Սամվել Կարապետյանի բնակարանի խուզարկությունը կատարվել է ապօրինի։

Փաստացի վերաքննիչ քրեական դատարանը հաստատում է, որ ռուսաստանցի գործարարին և բարերարին իրավապահները ձերբակալել են ապօրինաբար։ Մի կողմից, դատարանի այս որոշումը պետք է ստիպեր Նիկոլ Փաշինյանին և նրա իշխանությանը անհապաղ ազատ արձակել Սամվել Կարապետյանին, սակայն գործող իշխանությունները, թերևս, մտադրություն չունեն գնալու նման քայլի։ Բայց նույնիսկ ներհայկական ատյանի այս որոշումը փաստում է, որ Սամվել Կարապետյանի դեմ հարուցված քրեական գործը որևէ ապագա չունի։ Ավելին՝ հաշվի առնելով մի շարք հանգամանքներ, այդ թվում ամերիկյան լրատվամիջոցներում տարածված տեղեկությունները, թե Կոնգրեսում չափազանց մտահոգված են Սամվել Կարապետյանի և բարձրաստիճան եկեղեցականների դեմ բռնաճնշումներով, իսկ աշխարհահռչակ իրավաբան Ռոբերտ Ամստերդամն էլ ժամանել է Հայաստան՝ տեղում փաստահավաք առաքելություն իրականացնելու, նաև պաշտպանելու հոգևորականների ու Սամվել Կարապետյանի իրավունքները, ակնհայտ է, որ գործող իշխանությունները՝ Նիկոլ Փաշինյանի գլխավորությամբ, հայտնվել են իրենց իսկ հյուսած ծուղակում։

Նրանք այժմ չեն կարողանում կողմնորոշվել, թե որն է ավելի ձեռնտու՝ շարունակել ապօրինաբար պահել այս մարդկանց անազատության մեջ, թե ի վերջո խոստովանել իրենց կատարած ապօրինությունը և ազատ արձակել։ Ցանկացած պարագայում գործող իշխանությունների համար ծանր իրավիճակ է ստեղծվելու՝ հաշվի առնելով Սամվել Կարապետյանի ով լինելը և ունեցած հնարավորությունները։ Ուստի, ըստ ամենայնի, գործող իշխանությունները շարունակելու են նրան պահել կալանքի տակ որքան հնարավոր է երկար՝ խափանելով Կարապետյանի հռչակած ընդդիմադիր նոր ուժի ստեղծումը։
