Մարդու իրավունքների եվրոպական դատարանում (ՄԻԵԴ) հայ ռազմագերիների ներկայացուցիչ և փաստաբան Սիրանուշ Սահակյանը պարզաբանումներ է ներկայացրել Բաքվի դատարանում Ռուբեն Վարդանյանի իրավունքների կոպտագույն խախտումների վերաբերյալ:

Իրավապաշտպան Սիրանուշ Սահակյանը նշել է, որ կոպտորեն խախտվել են արդար դատաքննության երաշխիքները, մասնավորապես՝ կողմերի հավասարության և մրցակցության սկզբունքը: Թե՛ նախաքննական մարմինները, թե’ դատարանն անտեսել են պաշտպանական կողմի ներկայացրած բոլոր միջնորդությունները՝ իրականացնելով միակողմանի և կանխորոշված ելքով քննություն։ Ավելին, դատավորները մերժել են Ռուբեն Վարդանյանին տրամադրել լիարժեք հասանելիություն գործի նյութերին՝ միաժամանակ գործին կցելով կեղծված փաստաթղթեր։

Խախտվել են նաև ընդդատության երաշխիքները․ գործը փոխանցվել է ռազմական տրիբունալին, չնայած այն հանգամանքին, որ Ռուբեն Վարդանյանը քաղաքացիական անձ է և երբևէ որևէ առնչություն չի ունեցել իրավապահ կամ անվտանգային կառույցների հետ։ «Արդյունքում ստեղծվել է հիմնովին անարդար դատավարական իրավիճակ, որտեղ պաշտպանվող կողմը զրկված է մեղադրանքները վիճարկելու կամ իր անմեղությունն ապացուցելու իրատեսական որևէ հնարավորությունից։ Նման պայմաններում արդար դատաքննության հասկացությունն ինքնին վերածվում է ձևականության՝ զուրկ որևէ բովանդակությունից», -ընդգծել է Սահակյանը։
