Հակակոռուպցիոն դատարանում ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին և 2008 թվականին Պաշտպանության նախարարի տեղակալ Յուրի Խաչատուրովին «Մարտի 1»-ի գործով վերագրվող մեղադրանքները վերաորակվեցին։

Համաձայն հանրային մեղադրող Հայկ Հովհաննիսյանի ներկայացրած հիմնավորման՝ Ռոբերտ Քոչարյանին և Յուրի Խաչատուրովին մեղադրանք է առաջադրվում ՀՀ քրեական օրենսգրքի 441-րդ հոդվածի 2-րդ մասի 5-րդ կետով։ Մեղադրանքը վերաբերում է 2008 թվականի մարտի 1-ի իրադարձություններին, որոնց ընթացքում նրանք, ըստ մեղադրանքի, ակնհայտորեն անցել են իրենց պաշտոնական լիազորությունների շրջանակը, ինչի հետևանքով կոպտորեն խախտվել են քաղաքացիների սահմանադրական իրավունքները, և պատճառվել են ծանր հետևանքներ։

Համաձայն մեղադրանքի՝ Ռոբերտ Քոչարյանը, լինելով ՀՀ նախագահ, ցանկանում էր ապահովել իշխանության փոխանցումը Սերժ Սարգսյանին՝ խոչընդոտելով խաղաղ հավաքների անցկացումը։ Մեղադրանքում նշվում է, որ Քոչարյանն այս նպատակով հանցակցել է Յուրի Խաչատուրովի, Սեյրան Օհանյանի, Միքայել Հարությունյանի և այլ բարձրաստիճան պաշտոնյաների հետ՝ ապօրինի կերպով ներգրավելով զինված ուժերին և քաղաքացիական անձանց հետընտրական գործընթացներում։

Մասնավորապես, մեղադրանքը վերաբերում է պաշտոնատար անձանց կողմից դիտավորյալ կատարված այն գործողություններին, որոնք դուրս են եկել իրենց լիազորությունների շրջանակից՝ էական վնաս պատճառելով անձանց, կազմակերպությունների և պետության օրինական շահերին։

441-րդ հոդվածի 2-րդ մասի 5-րդ կետի համաձայն՝ նման արարքների համար պատիժ է սահմանվում  ազատազրկումը՝ չորսից ութ տարի ժամկետով։

Մեղադրող կողմը պնդեց, որ այս մեղադրանքը համապատասխանում է ՀՀ Սահմանադրական դատարանի 2024 թվականի որոշման դրույթներին, որոնք հնարավորություն են տալիս վերաորակավորել Քոչարյանի և մյուսների մեղադրանքները։

Դատական նիստը ժամանակավորապես ընդմիջվեց։

Հիշեցնենք՝ «Մարտի 1»-ի գործով Ռոբերտ Քոչարյանն ու մի շարք նախկին բարձրաստիճան պաշտոնյաներ 2021 թվականին արդարացվել էին՝ Սահմանադրական դատարանի կողմից հակասահմանադրական ճանաչված հոդվածի հիմքով։ Սակայն 2024 թվականի հուլիսին Սահմանադրական դատարանի որոշմամբ մեղադրանքը կարող է վերաորակավորվել, ինչի շնորհիվ  գործով դատավարությունը վերսկսվել է։
