Դանիբեկյանը ձգձգել է, որ արդարացման վճիռ չտա՞. «Փաստ»

«Փաստ» օրաթերթը գրում է.

«Շատ մի սիրիր, ատել կա» հայկական ասացվածքը լիովին համապատասխանում է ՔՊ-Աննա Դանիբեկյան ներկա հարաբերություններին։ Ինչպես հայտնի է, ԲԴԽ-ն հուլիսի 16-ին դադարեցրեց դատավոր Աննա Դանիբեկյանի լիազորությունները. պատճառը, ըստ հիմնավորման, ՀՀ երկրորդ նախագահի նկատմամբ հարուցված հայտնի «Սիլվայի գործի» իբր ձգձգումն է և Նիկոլ Փաշինյանի սրտով որոշում չկայացնելը։ Նիկոլ Փաշինյանի «սրտով» որոշումը, վստահաբար, Ռոբերտ Քոչարյանի՝ կա՛մ բանտում գտնվելն է, կա՛մ նրա նկատմամբ որևէ մեղադրական վճիռը։ Ու հիմա քպականները հարձակում են գործել մի դատավորի վրա, որին ժամանակին ծափահարում էին, գրառումներ նվիրում, երբ մեկուկես տարի շարունակ մերժում էր Ռոբերտ Քոչարյանի խափանման միջոց կալանքը փոխելու բոլոր միջնորդությունները։ Երկրորդ նախագահի նկատամբ, հիշեցնենք, երկու քրեական գործ կար Աննա Դանիբեկյանի տիրույթում։ Այդ նիստերը նա քննում էր հիմնականում մեկշաբաթյա ինտերվալով՝ յուրաքանչյուր երեքշաբթի օրը։ Այդ ժամանակ Ռոբերտ Քոչարյանը հումորով նշում էր, որ երեքշաբթին իր օրացուցից հանած է, որովհետև անիմաստ օր է։

Աննա Դանիբեկյանը մեկուկես տարի Ռոբերտ Քոչարյանին պահեց կալանքի տակ մի գործով, որը ճանաչվեց հակասահմանադրական։ Հիշենք, որ տևական ժամանակ դատական նիստերին հրավիրում էր քրեական գործի հետ կապ չունեցող՝ մարտի 1-ի զոհերի «հարազատներին» ու փաստաբաններին, ըստ երևույթին՝ շոու սարքելու համար։ Երբեմն էլ Աննա Դանիբեկյանը դատական նիստերը նշանակում էր խորհրդանշական օրերի, օրինակ՝ Հայաստանի համար հաղթանակի օրերին։ Երբ Ռոբերտ Քոչարյանի փաստաբանները կալանքը փոխելու միջնորդություն պետք է ներկայացնեին, Դանիբեկյանը ձգձգում էր քննությունը՝ մեկնելով արձակուրդ: Անգամ եղավ ժամանակահատված, երբ արձակուրդից վերադառնալուց անմիջապես հետո մեկնեց դասընթացների, կամ գնում էր քիթը վիրահատելու։ Տպավորություն էր, որ նրան ուղղակի ստիպում են կալանքի տակ պահել երկրորդ նախագահին։ Ի վերջո, քրեական գործը կարճվեց, բայց ՍԴ որոշման արդյունքում։ Հետո Աննա Դանիբեկյանը շարունակեց նիստերը՝ այս անգամ քննելով «Սիլվայի գործը»։

Այս գործը ևս ուներ խնդիրներ, բայց արդեն՝ հանցակազմի որոշման հետ։ Սակայն դատավոր Դանիբեկյանը շարունակեց քննել սա, դատախազներն էլ՝ նույն էնտուզիազմով պաշտպանել։ «Սիլվայի գործը» ունեցավ անսպասելի ավարտ։ 2023 թվականի մայիսին լրացել էր վաղեմության ժամկետը, որից Ռոբերտ Քոչարյանը չէր օգտվում։ 7 ամիս անց երկրորդ նախագահը քանիցս դիմեց դատարանին՝ թույլ տալու մեկնել արտասահման՝ բուժման նպատակով։ Դանիբեկյանը շարունակաբար մերժում էր երկրից բացակայելու միջնորդությունը, թեև չէր նշանակում դատական նիստեր։

Հերթական մերժումից հետո Ռոբերտ Քոչարյանը որոշեց օգտվել իր իրավունքից և դիմել վաղեմության ժամկետ կիրառելու համար, որովհետև առողջություն կամ դատական կապրիզների միջից ընտրեց առողջությունը. առողջական խնդիրները, ի դեպ, որքանով մեզ հայտնի է, առաջացել էին հենց կալանքի ընթացքում։ Այո, քպականները, ԲԴԽ-ն ճիշտ են՝ Աննա Դանիբեկյանը ձգձգել է դատերը։ Բայց հարց՝ ինչո՞ւ է ձգձգել, ո՞ւմ պահանջով կամ սպառնալիքով։ Գուցե վախեցե՞լ է արագ քննել, որովհետև ի սկզբանե պարզ է եղել իր համար, որ այս գործով մեղադրական վճիռն անհնար է, իսկ արդարացման դեպքում գուցե տեղի ունենար Փաշինյանի կոչով դատարանների արդեն անժամկետ արգելափակում...
