Աշխարհում և Հայաստանի Հանրապետությունում նոր կորոնավիրուսային հիվանդության (COVID-19) տարածման դեպքերը և այդ վարակը Առողջապահության համաշխարհային կազմակերպության գլխավոր տնօրենի` 2020 թվականի մարտի 13-ի հայտարարությամբ որպես պանդեմիա որակելու հանգամանքը, ելնելով նման արտակարգ իրավիճակում մարդկանց կյանքի և առողջության ապահովման գերակայության սկզբունքից, ՀՀ կառավարությունը մարտի 16-ին, արտահերթ նիստի ժամանակ որոշում ընդունեց Հայաստանի Հանրապետությունում արտակարգ դրություն հայտարարել մարտի 16-ից մինչև ապրիլի 14-ը: Ապրիլի 11-ին, վարչապետ Նիկոլ Փաշինյանն ուղիղ եթերում հայտարարեց, որ մտադրություն կա արտակարգ դրության ժամկետը երկարաձգելու 30 օրով։ Իրավաբան.net-ը տեղեկացնում է, որ «Արտակարգ դրության իրավական ռեժիմի մասին» ՀՀ օրենքի 5-րդ հոդվածով սահմանվում արտակարգ դրության գործողության ժամկետը: Հոդվածի համաձայն Հայաստանի Հանրապետության ամբողջ տարածքում հայտարարվող արտակարգ դրության ժամկետը չի կարող գերազանցել 30 օրը, իսկ առանձին տարածքներում` 60 օրը: Եթե մինչև նշված ժամկետների ավարտը չեն վերացել այն հանգամանքները, որոնք հիմք են հանդիսացել արտակարգ դրություն հայտարարելու համար, արտակարգ դրության ժամկետը կարող է երկարաձգվել Հայաստանի Հանրապետության կառավարության որոշմամբ` արտակարգ դրություն հայտարարելու համար սահմանված կարգով և վերոնշյալ 30-օրյա և 60-օրյա ժամկետները չգերազանցող ժամկետներով: Նույն օրենքի 6-րդ հոդվածով էլ սահմանվում է արտակարգ դրության դադարումը։ Համաձայն օրենքի, եթե արտակարգ դրություն հայտարարելու համար հիմք ծառայած հանգամանքները վերացել են մինչև արտակարգ դրության գործողության ժամկետի ավարտը, ապա արտակարգ դրությունը դադարեցվում է Հանրապետության Նախագահի հրամանագրով, որը ենթակա է անհապաղ հրապարակման հանրային հեռուստատեսությամբ, հանրային ռադիոյով, իսկ եթե դա հնարավոր չէ, ապա զանգվածային լրատվության այլ միջոցներով: Հանրապետության Նախագահի հրամանագիրն ուժի մեջ է մտնում հրապարակման պահից: Ազգային ժողովը կարող է չեղյալ հայտարարել արտակարգ դրության իրավական ռեժիմի ապահովմանն ուղղված ինչպես առանձին, այնպես էլ բոլոր միջոցառումների իրականացումը: Արտակարգ դրության իրավական ռեժիմի ապահովմանն ուղղված բոլոր միջոցառումների իրականացումը չեղյալ հայտարարելու դեպքում արտակարգ դրությունը դադարում է, իսկ առանձին միջոցառման իրականացումը չեղյալ հայտարարվելու դեպքում դադարում է այդ միջոցառման հետագա իրականացումը:
