Հայաստանի Հանրապետության իրավական իրականությունում խիստ մտահոգիչ է Պարետի ինստիտուտի եւ վերջինիս կողմից կայացված որոշումների իրավաչափությունը:

Այսպես, «Արտակարգ դրության իրավական ռեժիմի մասին» ՀՀ օրենքի 8- րդ հոդվածի 3-րդ մասի համաձայն՝ Արտակարգ դրություն հայտարարելու մասին Հայաստանի Հանրապետության կառավարության որոշմամբ կարող է ստեղծվել արտակարգ դրության տարածքի պարետատուն (այսուհետ` պարետատուն)` որպես համապատասխանաբար վարչապետին կամ փոխվարչապետին կից խորհրդակցական մարմին:

Պարետատունը ղեկավարում է պարետը: Պարետատան կազմը սահմանվում է արտակարգ դրություն հայտարարելու մասին Հայաստանի Հանրապետության կառավարության որոշմամբ, իսկ գործունեության կարգը կարող է սահմանել պարետը:

Վկայակոչված օրինադրույթի բովանդակային վերլուծությունից աներկբա բխում է, որ Պարետը բացառապես խորհրդակցական մարմնի՝ պարետատան ղեկավարն է, որը ԵՐԲԵՔ ԵՒ ՈՉ ՄԻ ՊԱՐԱԳԱՅՈՒՄ չի կարող ունենալ նորմատիվ բնույթի՝ համընդհանուր եւ համապարտադիր ակտերի ընդունման իրավասություն:

Նրա ընդունած ակտերը որեւէ կերպ չեն կարող համարվել Հայաստանի Հանրապետությունում ծագած հասարակական հարաբերությունների կազմակերպման եւ իրավական ուղեկցման նորմատիվային աղբյուր:

Ավելին, անգամ «Նորմատիվ իրավական ակտերի մասին» ՀՀ օրենքի 2-րդ հոդվածի 1-ին մասի 1-ին կետի համաձայն՝ նորմատիվ իրավական ակտ է համարվում Հայաստանի Հանրապետության ժողովրդի, ինչպես նաեւ Սահմանադրությամբ նախատեսված մարմինների կամ պաշտոնատար անձանց ընդունած գրավոր իրավական ակտ, որը պարունակում է վարքագծի պարտադիր կանոններ անորոշ թվով անձանց համար:

Մինչդեռ, պարետը ոչ պարագայում չի համարվում ո ́չ Սահմանադրությամբ նախատեսված մարմին, ո ́չ էլ դրանով նախատեսված պաշտոնատար անձ:

​Այսպիսով, վստահաբար կարելի է եզրակացնել եւ արձանագրել, որ Պարետի՝ մինչ այս պահն ընդունած որոշումներն իրավական առումով առոչինչ կամ կատարման համարժեք իրավական հիմք չունեցող փաստաթղթեր են, որպիսի փաստին կարելի է գնահատական տալ ինչպես վարչաիրավական կամ կարգապահական ներգործության միջոցների կիրառմամբ, այնպես էլ անհրաժեշտ հատկանիշների առկայության դեպքում քրեաիրավական հատկանիշների ենթադրյալ առկայության գնահատմամբ:

Նշված որոշումներով սահմանված պահանջների խախտման վերաբերյալ ցանկացած վարչական ակտ կարող է վերացվել վարչադատավարական կարգով:
