Լեռնային Ղարաբաղից բռնի տեղահանված մեր հայրենակիցները «ժամանակավոր պաշտպանության կարգավիճակ» ստանում են 1 տարի ժամկետով: Այդ մասին «Լուրերի» եթերում հայտարարեց ՆԳՆ միգրացիայի և քաղաքացիության ծառայության պետի տեղակալ Նելլի Դավթյանը:

Ըստ նրա՝ 3 խումբ անձինք են, որ ստանում են այս կարգավիճակը: Առաջին խմբում այն անձինք են, որոնք ունեն հաշվառում Լեռնային Ղարաբաղի բնակչության պետական ռեգիստրում:

Երկրորդ խմբում բոլոր այն անձինք են, որոնք չունեն այդ հաշվառումը ԼՂ բնակչության պետական ռեգիստրում, բայց վերջին հաշվառումը եղել է այնտեղ:

Երրորդ խմբում այն անձինք են, որոնք չունեն ԼՂ բնակչության պետական ռեգիստրում որևէ տեսակի հաշվառում, բայց քանի որ նրանց տեղահանության փաստ արձանագրվել է, հետևաբար նրանք հաշվառված են ՆԳՆ միգրացիայի և քաղաքացիության ծառայության տվյալների շտեմարանում: Այդ հաշվառումը կատարվել է տեղահանության ամսվա ընթացքում Կոռնիձորում, Վայքում և Գորիսում:

«Պետք է ուշադրություն հրավիրել այն հանգամանքի վրա, որ իմ նշած կատեգորիաների անձինք օգտվում են ժամանակավոր պաշտպանությունից, եթե չեն հանդիսանում որևէ պետության քաղաքացի, այդ թվում՝ ՀՀ-ի»,- ասաց Նելլի Դավթյան:

Իսկ ի՞նչ է ենթադրում «ժամանակավոր պաշտպանության կարգավիճակ» ստացած անձի իրավական կարգավիճակը, և ինչով է այն տարբերվում ՀՀ քաղաքացու իրավական կարգավիճակից:

Նելլի Դավթյանը պարզաբանեց՝ «ժամանակավոր պաշտպանության կարգավիճակը» տրված է 1 տարի ժամկետով, և բոլոր դեպքերում տվյալ պետության քաղաքացին ունի ավելի ընդարձակ իրավունքների փաթեթ, քան փախստականը: Օրինակ՝ սահմանափակված է նման կարգավիճակ ունեցող անձի ընտրվելու իրավունքը, սեփականության իրավունքով հող ունենալու հնարավորությունը և «տեղ-տեղ» նաև սահմանափակված է աշխատանքի իրավունքի իրացման հնարավորությունը: Օրինակ՝ հանրային ծառայությունն ունի այդ չափորոշիչը, որ դիմումատուն պետք է լինի ՀՀ քաղաքացի:

Ինչ վերաբերում է ԼՂ-ից բռնի տեղահանվածների այն մտահոգությանը, թե ՀՀ քաղաքացիություն ձեռք բերելուց հետո «ժամանակավոր պաշտպանության կարգավիճակ» ստացած անձը կդադարի օգտվել ՀՀ Կառավարության տրամադրած սոցիալական աջակցության ծրագրերից, Նելլի Դավթյանը տեղեկացրեց, որ ՀՀ քաղաքացիությունը չի սահմանափակում «ժամանակավոր պաշտպանության կարգավիճակ» ստացած անձանց մասով Կառավարության տրամադրած սոցիալական աջակցության ծրագրերից օգտվելու հնարավորությունը:
