2024 թվականի մարտի 11-ին ՀՀ ՆԳՆ ոստիկանության պարեկային ծառայության պարեկները, Երևան քաղաքի Մալաթիա-Սեբաստիա վարչական շրջանում ծառայություն իրականացնելիս, թմրամիջոց ապօրինի ձեռք բերելու, պահելու, օգտագործելու և իրացնելու անմիջականորեն ծագած հիմնավոր կասկածով, մի քաղաքացու տեղափոխել են ՀՀ ՆԳՆ ոստիկանության ԵՔՎ Մալաթիայի բաժին, ով, պարզվել է, հանդիսանում է Վարդենիս համայնքի բնակավայրերից մեկի բնակիչ։

Վերջինիս անձնական խուզարկությամբ հայտնաբերվել և վերցվել է 14 փաթեթ՝ բաց շագանակագույն, կոշտ զանգվածով։

Դեպքի առթիվ ՀՀ քննչական կոմիտեի ԵՔՔՎ Մալաթիա-Սեբաստիա վարչական շրջանի քննչական բաժնում, ՀՀ քրեական օրենսգրքի 393-րդ մասի 1-ին մասով, նախաձեռնվել է քրեական վարույթ։ Նշված քաղաքացին, հանցանք կատարած լինելու անմիջականորեն ծագած հիմնավոր կասկածով, ձերբակալվել է:

Նախաքննության ընթացքում կատարվել է ցուցմունքը տեղում ստուգելու քննչական գործողություն, որի ընթացքում հիշյալ անձը մատնացույց է արել այն վայրերը, որտեղ ինքը տեղադրել է տարբեր քաշերով ընդհանուր 6 փաթեթ թմրամիջոց։

Անձնական խուզարկությամբ և քննչական գործողությամբ հայտնաբերվածի և վերցվածի բաղադրությունը, ինչպես նաև այլ հարցեր պարզելու համար նշանակվել է դատանյութագիտական փորձաքննություն, որի եզրակացությամբ պարզվել է, որ փորձաքննության ենթարկված դարչնասպիտակավուն երանգի փոշեբյուրեղանման զանգվածը «a-PVP» կրճատ անվամբ թմրամիջոց է։

Ձեռք բերված բավարար փաստերի հիման վրա Վարդենիսի վերոհիշյալ բնակչին մեղադրանք է ներկայացվել՝ ՀՀ քրեական օրենսգրքի 393-րդ հոդվածի 3-րդ կետով՝ քննությամբ չպարզված վայրում և ժամանակահատվածում, ինքնությունը չպարզված անձից, իրացնելու նպատակով, շահադիտական դրդումներով ընդհանուր 20 փաթեթներում փաթեթավորված, առանձնապես խոշոր չափի՝ ընդհանուր 1,535 գրամ քաշով «a-PVP» կրճատ անվամբ թմրամիջոց ապօրինի ձեռք բերելու, պահելու և տեղափոխելու համար, որոնցից 14 փաթեթները հայտնաբերվել են վերջինիս անձնական խուզարկությամբ, իսկ 6-ը՝ տարբեր թաքստոցներից։ Վերջինս ընդունել է մեղքը։

Նախաքննության ընթացքում միջնորդություն է ներկայացվել դատարան՝ մեղադրյալի նկատմամբ կալանքը որպես խափանման միջոց կիրառելու վերաբերյալ, որը բավարարվել է։

Նախաքննությունը շարունակվում է: Ձեռնարկվում են անհրաժեշտ միջոցառումներ թմրամիջոցների ապօրինի շրջանառության շղթայում ներգրավված հնարավոր այլ մասնակիցներին հայտնաբերելու, թմրամիջոցի ձեռք բերման աղբյուրը պարզելու, նշված անձի (անձանց կողմից) թմրամիջոցների իրացման այլ դեպքեր բացահայտելու ուղղությամբ:

Ծանուցում. Հանցանքի համար մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով՝ դատարանի` օրինական ուժի մեջ մտած դատավճռով:
