Խիստ մտահոգությամբ ենք անդրադառնում պատերազմի նահատակ հերոսի հոր՝ Գարիկ Գալեյանի գործին, ով դատական իշխանության կողմից ենթարկվում է կալանքի անարդարացի և անհամաչափ կիրառման։

Գարիկ Գալեյանը, ում առաջադրվել են ոչ ծանր հանցանքների մեղադրանքներ, սկզբում կալանավորվել է, այնուհետև խափանման միջոցը փոխվել է տնային կալանքի։

Դատավարության ընթացքում դատարանի համար ակնհայտ է դարձել, որ Գալեյանն առողջական խնդիրներ ունի, բացի այդ դատական քննության ընթացքում ենթարկվել է վիրահատության։

Չնայած առողջական վիճակի հետ կապված այս հստակ մտահոգություններին՝ դատարանը որոշել է երկարացնել նրա տնային կալանքը ևս երկու ամսով՝ արդյունքում նաև զրկելով վերջինիս «Եռաբլուր» զինվորական պանթեոն-հուշահամալիր այցերից։ Հակառակ մեղադրանքի կողմից առարկությունների բացակայությանը՝ դատարանը պահանջել է, որ յուրաքանչյուր այց նախապես քննարկվի դատական նիստում։

Դժբախտաբար, այս որոշումից ընդամենը երկու օր անց Գարիկը հոսպիտալացվել է «սրտի կաթված» ախտորոշումով և ներկայում գտնվում է հիվանդանոցում։

Իրադարձությունների այս շարքը ոչ միայն ընդգծում է դատական իշխանության կողմից խափանման միջոցների անհամաչափ և պատժիչ կիրառումը, այլև լուրջ հարցեր է հարուցում մարդու իրավունքների և արդարադատության պահպանմանն ուղղված՝ դատական իշխանության հանձնառության վերաբերյալ: Դատարանի կայացրած որոշումները չեն կարողացել ապահովել բավարար փաստարկներ, որոնք կհամոզեն հասարակությանը, որ տնային կալանքը բացարձակապես անհրաժեշտ է եղել` հաշվի առնելով Գալեյանին առաջադրված մեղադրանքների հանգամանքները և վերջինիս առողջական վիճակը:

Փոխարենը, կալանքն ակնհայտորեն կիրառվում է որպես պատժի ձև, այլ ոչ թե օրինական խափանման միջոց: Սրա վառ վկայությունն է նաև այն, որ դատարանը՝ չարձանագրելով գործի քննությանը խոչընդոտելու ռիսկեր, սահմանափակել է Գալեյանի կապն արտաքին աշխարհի հետ։

Ավելին, կալանքի և տնային կալանքի նման անարդար կիրառման դեպքերը կարող են անդառնալի հետևանքների հանգեցնել, ինչի մասին վկայում է Գալեյանի առողջական վիճակի վատթարացումը։

Մենք կոչ ենք անում իրավապահ մարմիններին և դատական իշխանությանը  վերանայել կալանքի նկատմամբ իրենց մոտեցումը և ապահովել, որ այն օգտագործվի միայն խիստ անհրաժեշտության դեպքում և մարդու իրավունքների միջազգային չափանիշներին համապատասխան։

Կալանավորումը երբեք չպետք է օգտագործվի որպես պատժի միջոց, իսկ ազատության սահմանափակման յորաքանչյուր դեպք պետք է ունենա խիստ համոզիչ փաստակազմ։

Բացի այդ, դատական իշխանությունը պետք է ավելի կարեկից և նրբանկատ վերաբերմունք դրսևորի այն անհատների նկատմամբ, ովքեր արդեն իսկ ահռելի կորուստներ են կրել՝ հանուն պետության բարօրության:
