«ՀԱՅՏԱՐԱՐՈՒԹՅՈՒՆ

2020թ. հուլիսի 1-ին ԱԺ պատգամավոր Բ. Թունյանի հրավերով տեղի ունեցավ հեռավար քննարկում քաղաքացիների 5 մարդուց բաղկացած խմբի և Հարկային Օրենքում Գույքահարկի մասին օրենքի փոփոխությունների ԱԺ հեղինակային խմբի, Ֆինանսների փոխնախարարի և Կադաստրի վարչության պետի միջև: Մենք՝ քաղաքացիների խումբը նախապես ուղարկել էինք մեր նկատառումները և որոշ առաջարկություններ: Քննարկմանը հրավիրված քաղաքացիների կողմից բարձրաձայնվեցին օրենքի բովանդակային և օրենքի հանրային քննարկումների բացակայության մասին խնդիրներ: Մասնավորապես 1. Օրենքի ձևավորման համար պարտադիր և հիմնարար հասարակական, ժողովրդագրական, մշակութաբանական տվյալների բացակայությունը(օրենքի տրամաբանությանն անհրաժեշտ այս հարցերի որևէ վերլուծություն չի արվել), 2. Գույքահարկի օրենքի գոտիականությամբ պայմանավորված համայնքների բյուջեներին կանխատեսելիորեն անհամաչափ ազդեցությանը, 3. Օրենքում սոցիալական և մշակութային բաղադրիչի բացակայությանը, 4. Հայաստանի բնակչության տարբեր հասակական շերտերի շահերի և իրավունքների բացակայությանը, 5.Ներգաղթի և արտագաղթի վրա օրենքի հնարավոր ազդեցության հաշվարկման բացակայությանը, 6. Մշակութային կղզյակների կապիտալի պաշտպանությանն ուղղված մտահոգության բացակայությունը, 7. Գույքահարկի «շուկայական արժեք» հասկացության փիլիսոփայությանը: Վերջինս, մեր գնահատմամբ, ոչ թե ազատական տնտեսության իրավական ընթացքում ձևավորված գին/արժեք է, այլ վերջին 20 տարիներին քրեա-օլիգարխիկ երկրի տրամաբանությամբ ձևավորված արհեստական, չարդարացված գին, որն էլ որպես հաշվարկման հիմք դրվել է Գույքահարկի մասին օրենքի գնագոյացման հիմքում: Մենք գտնում ենք նաև, որ իշխանությունները պետք է ունենան Հայաստանի առանց այդ էլ շատ փոքր քաղաքային մշակութային շերտը ի դեմս այդ շերտը կրող մարդկանց և միջավայրերի պաշտպանելու քաղաքականություն: Սա շատ կարևորվում է, հատկապես նկատի ունենալով վերջին երեսուն տարիներին մասնավորապես Գյումրիում և Երևանում այդ շերտի պատմա-ճարտարապետական միջավայրի բնական և մարդածին ագրեսիվ ավերումների և այդ մշակույթը կրող մարդկանց դուրս մղումների հետևանքով առաջացած իրավիճակը: Մենք ուղղակի կորցնում ենք այդ շերտը:
Օրենքը ստեղծող, պաշտպանող և ընդունող կողմը տնտեսական և ֆինանսական հիմնավորումներով ներկայացրեց հատկապես օրենքի տեխնիկական բաղադրիչը: Մեր առաջ քաշած բոլոր հարցադրումները համարվեցին օրենքի ոգուն և նպատակներին չհամապատասխանող: Օրենքը ետ կանչելու, հանրային քննարկում ապահովելու և վերանայելու մեր առաջարկին պատասխանեցին, որ դա այլևս հնարավոր չէ, բայց մինչ օրենքն ուժի մեջ մտնելը այն կարող է լրացվել:
Գտնում ենք, որ Գույքահարկի մասին օրենքի թեման պետք է դառնա լուրջ մասնագիտական և հանրային քննարկման առարկա և հասարակական ճնշման ազդեցության տակ վերանայվի, հաշվի առնելով բոլոր բաղադրիչները: Մեզ պետք է իսկապես մարդակենտրոն և մշակութակենտրոն օրենք, ոչ թե ֆինանսա-տնտեսագիտական ցիրկուլյար:
