ՀՔԾ-ն «Էլեկտրիկ Երևան»-ի քրգործի շրջանակում մեղադրանք է առաջադրել ոստիկանության գնդապետին

ՀՀ հատուկ քննչական ծառայությունում քննվող «Էլեկտրիկ Երևան» անունով հայտնի քրեական գործի նախաքննության ընթացքում ձեռք բերված բավարար ապացույցների համակցության հիման վրա ՀՀ քրեական օրենսգրքի 309-րդ հոդվածի 2-րդ մասով ոստիկանության գնդապետ Ա. Ա.-ին մեղադրանք է առաջադրվել այն հանցավոր արարքի կատարման համար, որ վերջինս, զբաղեցնելով ՀՀ ոստիկանության համապատասխան վարչության պետի տեղակալի պաշտոնը, 2015 թվականի հունիսի 23-ին անցել է իր պաշտոնեական լիազորությունները, որը զուգորդվել է բռնության գործադրմամբ: Այս մասին տեղեկացրին ՀՀ հատուկ քննչական ծառայությունից։

«Ըստ առաջադրված մեղադրանքի` 2015 թվականի հունիսի 23-ին` ՀՀ ոստիկանության ծառայողների կողմից էլեկտրաէներգիայի թանկացման դեմ Երևան քաղաքում անցկացվող հավաքը ցրելու ընթացքում, Ազատության հրապարակին հարակից տարածքում, Ա. Ա.-ն ոստիկանության երկու այլ ծառայողների հետ բռնել է հավաքի մասնակիցներից Ֆիլիպ Արզումանյանին և, դուրս գալով իր պաշտոնեական լիազորությունների շրջանակից, բռունցքով երկու անգամ դիտավորությամբ հարվածել է նրա գլխի շրջանին` էական վնաս պատճառելով Ֆիլիպ Արզումանյանի իրավունքներին ու օրինական շահերին:

Քրեական գործից Ա. Ա.-ի վերաբերյալ անջատված մասով նախաքննությունն ավարտվել է: Գործը մեղադրական եզրակացությամբ ուղարկվել է հսկողություն իրականացնող դատախազին` այն դատարան ուղարկելու միջնորդությամբ:

Հիշեցնենք, որ ՀՀ հատուկ քննչական ծառայությունում վերը նշված քրեական գործի նախաքննության ընթացքում մի շարք այլ դրվագներով ևս հնարավոր է եղել ձեռք բերել հանցանքի կատարումը վկայող բավարար ապացույցների համակցություն, որի հիման վրա ՀՀ քրեական օրենսգրքի 164-րդ հոդվածի 2-րդ մասով, 164-րդ հոդվածի 1-ին մասով և 185-րդ հոդվածի 1-ին մասով մեղադրանքներ են առաջադրվել ՀՀ ոստիկանության 4 ծառայողների, որոնց վերաբերյալ քրեական գործը մեղադրական եզրակացությամբ ուղարկվել է դատարան: Նրանց վերաբերյալ արդեն կան օրինական ուժի մեջ մտած դատավճիռներ:

Ծանուցում. ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով»,- ասվում է հաղորդագրության մեջ:
