ԶՊՄԿ անվտանգության դեպարտամենտի նախկին ղեկավար Արամ Գասպարյանն արդեն մոտ 17 ամիս՝ ավելի քան 530 օր գտնվում է անազատության մեջ: Սա՝ այն պայմաններում, երբ անազատության մեջ գտնվելու ընթացքում ունեցել է առողջական խնդիրներ, որոնց մասին, սակայն, ինչպես իրեն ճանաչողներն են ասում, առանձնապես չի բարձրաձայնել՝ ելնելով իր անցած ճանապարհից, մարդկային տեսակից և երեք պատերազմներին մասնակցելու փաստից: «Փաստ» թերթի տեղեկություններով, գտնվելով ՀՀ ԱՆ «Վարդաշեն» ՔԿՀ-ում, Գասպարյանը նաև ունեցել է առողջական վիճակի այնպիսի վատթարացում, որ ՔԿՀ վարչակազմը ստիպված է եղել գրանցել շտապ օգնության կանչ:

Ի դեպ, որքան մեզ է հայտնի, մինչև կալանավորումը Գասպարյանը նման առողջական խնդիրներ չի ունեցել: Իրավաբանները նշում են, որ իրավունքի մեջ այս իրավիճակը բնութագրվում է որպես մարդու խոշտանգում: Ավելին, մոտ 7 ամիս, ինչպես Արամ Գասպարյանի փաստաբաններն են նշում, դատարանի կողմից նա լսված չի եղել: Ի մասնավորի, նրա խափանման միջոցը փոխելու հարցը քննարկվել էր 2022 թվականի հուլիսի 26-ին: Դատավոր Ֆարխոյանը միջնորդությունը մերժել էր, սակայն դրան հաջորդած ժամանակահատվածում՝ մինչ հունվարի 30-ը, դատարանն ընդամենը երեք դատական նիստ է նշանակել, որոնք փաստացի չեն կայացել, որոնցից մեկը՝ դատական իշխանության կողմից ժողովի նախաձեռնման հետևանքով:

Այսինքն, դատարանը, փաստացի գիտակցելով, որ իր որոշմամբ կա կալանավորված անձ, 7 ամսվա մեջ ընդամենը երեք դատական նիստ է նշանակում, որոնցից մեկն էլ չի կայանում դատավորի՝ ժողովի մասնակցելու պատճառով: Հավելենք, որ ըստ իրավաբանների, քրեական վարույթն ամբողջությամբ կազմված է ընդամենը ինչ-որ կենցաղային խոսակցությունների վրա, և Արամ Գասպարյանը 530 օրից ավելի կալանավորված է այնպիսի մեղադրանքներով, որոնց պարագայում, նույնիսկ գործում ոչ մի փաստ չլինելու պայմաններում, բայց մեղադրական բնույթի դատավճռի դեպքում, անխուսափելիորեն գործելու է ՀՀ քրեական օրենսգրքի՝ պատիժը կրելուց պայմանական վաղաժամկետ ազատելու ինստիտուտը, որի պայմաններում Արամ Գասպարյանն արդեն իսկ փաստացի պատժի 1/3 կրելու հիմքով կարող էր հենց հիմա ազատ արձակվել: Սակայն նույնիսկ այս պայմաններում դատավոր Ֆարխոյանը գտնում է, որ Արամ Գասպարյանը պետք է շարունակի մնալ կալանավորված:

Դեռևս 2021 թվականի դեկտեմբերին դատավոր Արմեն Դանիել յանը, որը հայտնի է իշխանությունների ցանկությամբ բոլորին կալանավորելով, գտել էր, որ Արամ Գասպարյանին պետք է կալանավորել, քանի որ երկու վկա կա, որոնք պետք է լսվեն դատարանում: Այդ երկու վկաները լսվել են դեռևս 2022 թվականի հուլիսին, բայց 2023 թվականի փետրվար ամիսն է, այնինչ Արամ Գասպարյանը դեռ կալանավորված է: Այսինքն, ստացվում է, որ Ֆարխոյանը գերազանցում է նույնիսկ Արմեն Դանիել յանին:

Ի դեպ, հավելենք, որ Մարդու իրավունքների եվրոպական դատարանը բազմաթիվ վճիռներում, այդ թվում՝ Հայաստանի դեմ կայացված գործերով, նշել է, որ վկաների նկատմամբ ճնշումների վտանգն ընդունելի է վարույթի սկզբնական փուլում. այնուամենայնիվ, գործի քննության ընթացքում դրանք այլևս բավարար չեն անձի կալանքը հիմնավորելու համար։ Այս հանգամանքը ևս հստակ նշվել ու հիմնավորվել է դատարանում, սակայն, ինչպես երևում է, դատավոր Ֆարխոյանի համար նույնիսկ դա նշանակություն չունի:
