Մարդու իրավունքների եվրոպական դատարանն այսօր հրատապ ծանուցում է ուղարկել Եվրոպայի խորհրդի Նախարարների կոմիտեին Լաչինի միջանցքը ապաշրջափակելու մասին իր՝ 2022 թվականի դեկտեմբերի 21-ի որոշման կատարումը Ադրբեջանի կողմից վերահսկելու նպատակով: Տեղեկությունը հայտնում է Միջազգային իրավական հարցերով ՀՀ ներկայացուցչի գրասենյակը։

Դեկտեմբերի 21-ին ՄԻԵԴ–ը բավարարել էր Հայաստանի պահանջը և պարտավորեցրել Ադրբեջանին ապահովել միջանցքով Հայաստանում բժշկական օգնություն ստանալու կարիք ունեցող ծանր հիվանդների տեղաշարժը, ինչպես նաև ճանապարհին անապաստան մնացած կամ ապրուստի միջոցների կարիք ունեցող անձանց անվտանգ տեղաշարժը։

2022 թվականի դեկտեմբերի 22-ին Ադրբեջանը դիմել էր Եվրոպական դատարան՝ պահանջելով վերացնել միջանկյալ միջոց կիրառելու որոշումն ու միջանկյալ միջոցներ կիրառել Հայաստանի դեմ, այն է՝ «ձեռնարկել իր իրավասությունից բխող բոլոր միջոցները` ուղղված ՌԴ խաղաղապահների ժամանակավոր տեղակայման վայրում գտնվող Ադրբեջանի տարածքում բժշկական անհետաձգելի օգնության կարիք ունեցող մարդկանց համարժեք բուժմանը և խուսափել այս ուղղությամբ որևէ խոչընդոտ ստեղծելուց»:

Ի պատասխան Ադրբեջանի դիմումի` Միջազգային իրավական հարցերով ներկայացուցչի գրասենյակը 2022 թվականի դեկտեմբերին և 2023 թվականի հունվարին ՄԻԵԴ է ուղարկել պարբերաբար թարմացվող տեղեկություն Լեռնային Ղարաբաղում տիրող հումանիտար ծանր վիճակի մասին։ Հայկական կողմը Եվրոպական դատարանից պահանջել էր անհապաղ ծանուցում ուղարկել Եվրոպայի խորհրդի Նախարարների կոմիտեին Ադրբեջանի կողմից Եվրոպական դատարանի 2022 թվականի դեկտեմբերի 21-ի որոշումը չկատարելու վերաբերյալ:

«Եվրոպական դատարանը, հաշվի առնելով կողմերի ներկայացրած փաստարկները, այսօր մերժել է Ադրբեջանի պահանջներն ամբողջությամբ՝ 2022 թվականի դեկտեմբերի 21-ի որոշումը թողնելով ուժի մեջ»,– նշված է ՀՀ ներկայացուցչի գրասենյակի տարածած հաղորդագրության մեջ։

ՄԻԵԴ–ը մերժել է նաև Հայաստանի դեմ միջանկյալ միջոց կիրառելու մասին Ադրբեջանի պահանջը:
