Հաշվեքննիչ պալատը ստուգումներ կիրականացնի նաեւ ՀԾԿՀ-ում․ նոր նախագիծ

ՀՀ Ազգային ժողովի ֆինանսավարկային եւ բյուջետային հարցերի մշտական հանձնաժողովի պատգամավոր Արտակ Մանուկյանն իմքայլական մի քանի պատգամավորների հետ միասին ներկայացրել է «Հաշվեքննիչ պալատի մասին» օրենքում փոփոխություններ եւ լրացումներ կատարելու մասին օրենսդրական նախագիծ։ Պատգամավորներն առաջարկում են հնարավորություն տալ, որպեսզի Հաշվեքննիչ պալատն իրավասություն ունենա հաշվեքննություն իրականացնել նաեւ Հանրային ծառայությունները կարգավորող հանձնաժողովում։

Նախ նկատենք, որ ՀՀ Սահմանադրության 198-րդ հոդվածի 1-ին մասի համաձայն, Հաշվեքննիչ պալատն անկախ պետական մարմին է, որը հանրային ֆինանսների եւ սեփականության ոլորտում հաշվեքննություն է իրականացնում պետական բյուջեի եւ համայնքային բյուջեների միջոցների, ստացած փոխառությունների ու վարկերի, պետական եւ համայնքային սեփականության օգտագործման օրինականության եւ արդյունավետության նկատմամբ: Համաձայն ՀՀ Սահմանադրության 198-րդ հոդվածի 4-րդ մասի, Հաշվեքննիչ պալատի լիազորությունները, գործունեության կարգը եւ երաշխիքները սահմանվում են «Հաշվեքննիչ պալատի մասին» օրենքով :

Եվ քանի որ ըստ օրենքի, Հաշվեքննիչ պալատը հաշվեքննություն է իրականացնում պետական բյուջեի եւ համայնքային բյուջեների միջոցներից ֆինանսավորվող պետական եւ տեղական ինքնակառավարման մարմիններում, ապա նախագծի հեղինակները նկատում են, որ Հաշվեքննիչ պալատն իրավասու է հաշվեքննություն իրականացնել նաեւ Հանրային ծառայությունները կարգավորող հանձնաժողովում` գնահատելով վերջինիս ֆինանսատնտեսական գործունենությունը կարգավորող իրավական ակտերով կամ քաղաքացիաիրավական հարաբերությունների շրջանակներում կնքված գործարքներով սահմանված չափանիշների եւ պահանջների պահպանումը:

Պատգամավորները դիտարկել են նաեւ հանձնաժողովի՝ 2019 թվականի ֆինանսատնտեսական գոործունեությունը և նշել, որ հանձնաժողովին պետական բյուջեից հատկացված միջոցների (792,5 մլն դրամ) միայն 99 տոկոսը բաժին է ընկնում «Հանրային ծառայությունների ոլորտի կարգավորում» 1064 բյուջետային ծրագրին, հետեւաբար կարելի է պնդել, որ Հանձնաժողովում հաշվեքննություն իրականացնելը էապես պայմանավորված է հանրային ծառայությունների ոլորտի կարգավորման ուսումնասիրությամբ։ Իսկ դիտարկելով Հանձնաժողովի 2020 թվականի գործունեության ծրագիրը, պարզ է դառնում, որ Հանձնաժողովն իր հերթին սահմանել է առաջնահերթություններ, որոնք վկայում են, որ կառույցի գործունեության արդյունավետությունը կայանում է կարգավորման անձանց գործունեության նկատմամբ իրականացվող հսկողության լիարժեքությամբ եւ օրինականությամբ:
