Վճռաբեկ դատարանը 2022 թվականի հունիսի 30-ի նախադեպային որոշմամբ Արա Շահնազարյանի վերաբերյալ գործով միջազգային չափանիշներին համապատասխան, ուղենիշային դիրքորոշումներ է արտահայտել տևական ժամանակ իրավակիրառ պրակտիկայում հակասական լուծումների տեղիք տվող՝ առաջին ատյանի դատարանների կողմից կարգադրված օպերատիվ-հետախուզական գործունեության միջոցառումների վերաբերյալ որոշումները վերադասության կարգով վիճարկելու սուբյեկտային հարցի շուրջ։

ԲԴԽ-ից հայտնում են, որ հաշվի առնելով, որ դրանք «թիրախավորում» են ոչ միայն այն անձանց, ովքեր ուղղակի առնչություն են ունեցել հանցավոր դեպքին, այլ նաև անուղղակի առնչություն ունեցողներին, Վճռաբեկ դատարանը հստակեցրել է այդ երկու խումբ անձանց նկատմամբ իրականացված օպերատիվ-հետախուզական միջոցառումների կապակցությամբ արդյունավետ իրավական պաշտպանություն հայցելու կառուցակարգը և այն չափանիշը, որի պայմաններում այդ կառուցակարգը կարող է գործադրվել։

Վճռաբեկ դատարանն ընդունելի է համարել, որ քրեական գործի ըստ էության քննության շրջանակներում օպերատիվ-հետախուզական միջոցառման իրականացումը թույլատրելու վերաբերյալ դատարանի որոշումը վիճարկելու հնարավորությունը չի կարող դիտարկվել «արդյունավետ վերահսկողության» մեխանիզմ։ Մի շարք իրավական դոկտրինների, Մարդու իրավունքների եվրոպական դատարանի իրավական դիրքորոշումների վերլուծության հիման վրա, Վճռաբեկ դատարանն արձանագրել է, որ օպերատիվ-հետախուզական միջոցառման իրականացումը թույլատրելու վերաբերյալ դատարանի որոշման նկատմամբ «արդյունավետ վերահսկողություն» կարող է դիտարկվել բացառապես դրա իրավաչափությունը վերադաս դատական ատյանում վիճարկելը։

Միաժամանակ, ներկայացված պատճառաբանությունների հիման վրա, Վճռաբեկ դատարանը սահմանել է, որ երկաստիճան չափանիշը ենթադրում է հետևյալ հարցերի պարզում.

ա) արդյո՞ք անձի մասնավոր կյանքի անձեռնմխելիության իրավունքի նկատմամբ տեղի է ունեցել միջամտություն,

բ) եթե այո, ապա արդյո՞ք այդպիսի միջամտությունն ուղղակի կամ անուղղակի վնաս է պատճառել անձին կամ ազդեցություն թողել իր լեգիտիմ շահերի վրա։

Լուծելով իրավակիրառ պրակտիկայում հակասական լուծումների տեղիք տված խնդիրը՝ Վճռաբեկ դատարանը գտել է, որ օպերատիվ-հետախուզական միջոցառման իրականացումը թույլատրելու վերաբերյալ դատարանի որոշումը ստուգելու «արդյունավետ վերահսկողության» մեխանիզմը կարող է գործադրվել դրա իրավաչափությունը վերադաս դատական ատյանի կարգով վիճարկելու ճանապարհով այն դեպքում, երբ այդ միջոցառման արդյունքում անձը դարձել է մասնավոր կյանքի անձենմխելիության իրավունքի խախտման զոհ։
