ՍԴ-ն ասել է իր խոսքը այդ հոդվածի սահմանադրականության հետ կապված, ես կարծում եմ, որ դատարանն էլ այսօր իր խոսքը պետք է ասի եւ հանցակազմի բացակայության պատճառով պետք է կարճի բոլորի նկատմամբ: Այս մասին, այսօր՝ մարտի 30-ին, դատարանի բակում լրագրողների հետ զրույցում նշեց պաշտպանության նախկին նախարար Սեյրան Օհանյանը:

Նշենք, որ այսօր դատարանում նախատեսված է Ռոբերտ Քոչարյանի եւ մյուսների գործով դատակն նիստը:

«ՍԴ-ի որոշումը ճիշտ որոշում է, ամեն դեպքում այդ որոշումը եւս մեկ անգամ փաստում է, որ այս հոդվածով նաեւ քաղաքական հետապնդում է եղել մեր նկատմամբ: Ես դեռ այն ժամանակ ասել էի, որ չեմ հասկանում մեղադրանքի էությունն իմ նկատմամբ: Ես այն ժամանակ (նկատի ունի 2008 թվականի մարտի 1-ին-խմբ) գլխավոր շտաբի պետ եմ եղել: Ուզում եմ հիշեցնել, որ 2008-ի դեկտեմբերի 25-ին է «Պաշտպանության մասին» օրենքը փոխվել եւ ԳՇ պետը դարձել զորային կառույցի ղեկավար: Ես երբ եղել եմ ԳՇ պետ, ես հրամանատար չեմ եղել: Մեղադրանքի հիմքում դրված էր այն, որ ես ընթերցել եմ արտակարգ դրության հրամանագրի համաձայն , թե զինված ուժերն ինչ խնդիրներ պետք է կատարեն: Զինված ուժերը պետք է կատարեն պետական պահպանության օբյեկտների պահպանության խնդիրը: Պարզապես ընթերցել եմ եւ այսօր դատարանը պետք է իր որոշումն ընդունի»,-ասաց նա:

Հիշեցնենք, որ մարտի 26-ին Սահմանադրական դատարանը ՀՀ ՔՕ 300.1-րդ հոդվածը ճանաչել է Սահմանադրության 78-րդ (համաչափության սկզբունքը) եւ 79-րդ (որոշակիության սկզբունքը) հոդվածներին հակասող եւ անվավեր։

Նշենք, որ այս հոդվածի հատկանիշներով է մեղադրանք առաջադրված ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանի, Պաշտպանության նախկին նախարար Սեյրան Օհանյանի, ԶՈՒ ԳՇ նախկին պետ Յուրի Խաչատուրվի, ՀՀ նախագահի աշխատակազմի նախկին ղեկավար Արմեն Գեւորգյանի նկատմամբ։
