Ռոբերտ Քոչարյանից բացի էլ ում էր վերաբերում ՍԴ-ի երեկվա որոշումը

«Ժողովուրդ» թերթը գրում է. «ՀՀ Սահմանադրական դատարանի շուրջ ստեղծված ճգնաժամը վերջացած է»,- 2020 թվականի սեպտեմբերի 16-ին հայտարարեց ՀՀ վարչապետ Նիկոլ Փաշինյանը, երբ Հրայր Թովմասյանին երկար չարչարանքներից հետո գահընկեց արեցին։ Այս հայտարարությունից 6 ամիս անց նաև Նիկոլ Փաշինյանի կողմից ՍԴ գործուղված դատավորները միաձայն ՀՀ ՔՕ 300.1 հոդվածը հակասահմանադրական ճանաչեցին։ Այդ հոդվածով մեղադրանք է առաջադրված ՀՀ երկրորդ նախագահ Ռոբերտ Քոչարյանին և մի շարք նախկին պաշտոնյաների՝ 2008-ի «Մարտի 1»-ի գործի անվան տակ, որը, փաստորեն, հակասում է Սահմանադրության 78 և 79-րդ հոդվածներին և անվավեր պետք է ճանաչվի։

Նկատենք՝ երբ 2018 թվականի հուլիսի 26-ին Ռոբերտ Քոչարյանին մեղադրանք առաջադրվեց այդ հոդվածով, որով ՀՔԾ պետ Սասուն Խաչատրյանը և Գլխավոր դատախազ Արթուր Դավթյանը փորձում էին ապացուցել, թե Քոչարյանը այլ անձանց հետ նախնական համաձայնությամբ տապալել է Հայաստանի Հանրապետության սահմանադրական կարգը, շատ մասնագետներ և իրավաբաններ նշում էին, որ ի սկզբանե այն ձախողված գործ է:

Սակայն Դատախազությունը, Հատուկ քննչական ծառայությունը, նաև պատգամավոր Անդրանիկ Քոչարյանը հպարտանում էին, որ կարողացել են մեղադրանք առաջադրել երկրորդ նախագահին և կալանավորել, ու արդարությունն արդեն իսկ հաղթանակել է: Սակայն գրեթե երեք տարի անց Սահմանադրական դատարանը ուշագրավ որոշում կայացրեց և այդ հոդվածը ճանաչեց հակասահմանադրական։

Երեկ Քոչարյանի փաստաբան Արամ Վարդևանյանը հայտարարեց, որ դատավոր Աննա Դանիբեկյանը 300.1 հոդվածով քրեական հետապնդումը դադարեցնելու է։ «ՍԴ-ի որոշման ուժով այն բոլոր ակտերը, որոնք վերաբերում են 300.1 հոդվածին, ընդունման պահից ի վեր ուժ չունեն ու ենթակա են վերանայման», – նշեց նա՝ հպարտանալով, որ իր պաշտպանյալը, ըստ էության, «մաքրվեց»։

Իսկ ինչ արժեցավ հակասահմանադրական ճանաչված այս հոդվածը մեր երկրի վրա. 2018 թվականի նոյեմբերին ՀԱՊԿ գլխավոր քարտուղարի պաշտոնից հետ կանչվեց Յուրի Խաչատուրովը՝ հենց այդ մեղադրանքով, մինչև այժմ հետախուզման մեջ գտնվող պաշտպանության նախկին նախարար Միքայել Հարությունյանը և Սեյրան Օհանյանը ևս մեղադրվում են այդ հոդվածով:

Այսինքն՝ հայոց բանակի գլխավոր շտաբի 3 նախկին պետեր հետապնդվեցին այս ապօրինի հոդվածով, և այսօր պետք է ասենք, որ երեք տարի ձգված դատական պրոցեսը, ըստ էության, անօգուտ զբաղմունք էր, որի արդյունքում Հայաստանն էլ հայտնվեց իրավական մեծ փոսում:

Հիշեցնենք, որ ՍԴ-ի կողմից մերժված այս հոդվածը դեռ 2008-ին կալանավորված քաղբանտարկյալների գործի եվրաքննության ժամանակ վիճահարույց էր ճանաչվել։
