ՀՀ վարչական դատարանի դատավոր Մհեր Պետրոսյանը ընդունելով Օնիկ Գասպարյանի դիմումը, միաժամանակ, կիրառել է հայցի ապահովման միջոց: Այսինքն, դատարանը, ըստ էության, կասեցրել է ոչ միայն Օնիկ Գասպարյանին իրավունքի ուժով պաշտոնից ազատելու հանգամանքը, այլև, հետևաբար, դրանով իսկ արգելել է նրա փոխարեն նշանակել այլ անձի: Սակայն, իշխանությունը, ի դեմս կառավարության, ոչ միայն հայտարարեց որ այդ որոշումը ապօրինի է, այլև՝ վարչապետը առաջարկեց, իսկ Արմեն Սարգսյանը նշանակեց Արտակ Դավթյանին ՀՀ ԳՇ պաշտոնին:

Ստացվում է, որ Նիկոլ Փաշինյանը և Արմեն Սարգսյանը ապօրինի են համարել դատարանի օրինական ուժի մեջ մտած որոշումը, և հակառակ այդ որոշման կարգավորումների, Արտակ Դավթյանին նշանակել են այդ պաշտոնում:

Բայց տեղի է ունեցել անհավանական մի բան՝ ՀՀ արդարադատության նախարարությունը հաստատել է այն փաստը, որ Նիկոլ Փաշինյանը և Արմեն Սարգսյանը հանցագործ են և կատարել են ՀՀ քր.օր-ի 353-րդ հոդվածով նախատեսված հանցագործություն: Մանրամասնեմ. Նիկոլ Փաշինյանը և Արմեն Սարգսյանը միասնական հանցավոր դիտավորությամբ, անտեսելով ՀՀ վարչական դատարանի կողմից ընդունված որոշումը՝ հայցի ապահովման միջոց կիրառելու մասին, Արտակ Դավթյանին հանցակիցներից մեկի միջնոդությամբ և մյուսի հրամանագրով նշանակում են ՀՀ ԳՇ պետի պաշտոնում: Սակայն, միևնույն ժամանակ, ՀՀ արդարադատության նախարարությունը միջնորդություն է ներկայացնում դատարան՝ հայցի ապահովման միջոցը վերացնելու համար:

Այսինքն, մի կողմից ՀՀ վարչապետն ու ՀՀ Նախագահը համարում են, որ դատական այդ ակտն ապօրինի է կամ չի սահմանափակում իրենց լիազորությունները ԳՇ պետի պաշտոնում նոր նաշանակում անելու համար, մյուս կողմից՝ ՀՀ արդարադատության նախարարությունը ներկայացնում է միջնորդություն հայցի ապահովումը վերացնելու, այն է՝ ԳՇ պետի պաշտոնում նոր նշանակում կատարելու սահմանափակումը վերացնելու համար: Այսինքն, ՀՀ արդարադատության նախարարության միջնորդություն ներկայացնելու փաստն, ինքնին, հիմնավորում է, որ ՀՀ վարչապետն ու ՀՀ Նախագահը դիտավորությամբ չեն կատարել ՀՀ դատական ակտն ու ՀՀ ԳՇ պետ նշանակելու իրենց իրավասությունը սահմանափակված լինելու պայմաններում, մեկը միջնորդել, մյուսը՝ հրամանագրել է նոր նշանակումը:

Այս փաստը արդեն բավարար է ՀՀ քր.օր-ի 308-րդ և 353-րդ հոդվածի հատկանիշներով քրեական գործ հարուցելու համար:
