«Փաստ» օրաթերթը գրում է. «Ազգային անվտանգության ծառայությունն առաջարկում է արդիականացնել «Պետական եւ ծառայողական գաղտնիքի մասին» օրենքը: Նախագծի մեջ նշվում է, որ ՀՀ վարչապետի 2020 թ. հոկտեմբերի 30-ի N 1208-Ա որոշմամբ «Պետական եւ ծառայողական գաղտնիքի մասին» նոր օրենքի նախագծի մշակման եւ հարակից իրավական ակտերի արդիականացման աշխատանքներն իրականացնելու նպատակով ստեղծվել է աշխատանքային խումբ, որի կողմից տվյալ որոշման մեջ նշված պետական կառավարման համակարգի մարմիններից ստացված առաջարկությունների հիման վրա մշակվել է «Պետական եւ ծառայողական գաղտնիքի մասին» օրենքի նախագծը:

Ազգային անվտանգության ծառայությունը համարում է, որ «Պետական եւ ծառայողական գաղտնիքի մասին» գործող օրենքը բովանդակային եւ օրենսդրական տեսանկյունից ամբողջական բարեփոխման եւ կատարելագործման կարիք ունի, այն ընդունվել է 1996 թ.-ին, եւ դրանում առկա մի շարք իրավակարգավորումներ չեն արտահայտում ներկա իրողությունները, ինչպես նաեւ միջազգային փորձը:

Օրինակ՝ գործող օրենքում լիարժեքորեն նախանշված չէ տեղեկությունները պետական եւ ծառայողական գաղտնիքի շարքին դասելու եւ դրանց պաշտպանության բնագավառում կառավարության լիազորությունների շրջանակը, սահմանված չեն օրենքում կիրառվող հիմնական հասկացությունները, հստակեցված չեն գաղտնի տեղեկությունների գաղտնազերծման, դրանց վերանայման ժամկետները, ինչպես նաեւ մի շարք այլ իրավակարգավորումներ:

Այսպիսով՝ ՀՀ անվտանգության ապահովմանն ուղղված որոշակի բնագավառի տեղեկություններ պետական եւ ծառայողական գաղտնիքի շարքին դասելու, գաղտնազերծելու եւ պաշտպանելու, ինչպես նաեւ պետական եւ ծառայողական գաղտնիքի հետ կապված այլ կարգավորումներն արդիականացնելու նպատակով «Պետական եւ ծառայողական գաղտնիքի մասին» օրենքի նախագծում հստակեցվել են գաղտնիության աստիճանի, գաղտնի տեղեկություններին առնչվող թույլտվության, դրանց պաշտպանությանմիջոցների, գաղտնիության դրոշմագրի եւ այլ հասկացությունների սահմանումները:

Հստակեցվել է նաեւ տեղեկությունները պետական եւ ծառայողական գաղտնիքի շարքին դասելու եւ դրանց պաշտպանության բնագավառում Կառավարության լիազորությունների շրջանակը, ինչպես նաեւ նախատեսվել են մի շարք այլ իրավակարգավորումներ: Նախագծի ընդունմամբ բովանդակային եւ օրենսդրական առումով կփոփոխվեն պետական եւ ծառայողական գաղտնիքի հետ կապված հարաբերությունների՝ ներկայումս գործող իրավակարգավորումները, դրանք կհամապատասխանեցվեն արդի իրողություններին եւ միջազգային փորձին, ինչպես նաեւ կներդրվեն գաղտնի տեղեկատվության պաշտպանությանն ուղղված նոր գործիքակազմեր եւ լուծումներ»:
