Արտերկրում բնակվող անձը չպետք է մեխանիկորեն զրկվի կենսաթոշակից տարին 1 անգամ բանկ չներկայանալու պատճառով․ ՄԻՊ-ն առաջարկել է «Պետական կենսաթոշակների մասին» ՀՀ օրենքում փոփոխություններ կատարել

Հայաստանի տարածքից դուրս գտնվող Հայաստանի քաղաքացիների կենսաթոշակի վճարման մեխանիկական դադարեցումը տարեկան մեկ անգամ բանկ չներկայանալու դեպքում վիճահարույց է։ Այս խնդիրն արտացոլված է Մարդու իրավունքների պաշտպանի 2019 թվականի տարեկան հաղորդման մեջ։ Այս մասին հայտնում են ՄԻՊ գրասենյակից։

Հարցն այն է, որ գործող օրենքով՝ կենսաթոշակի վճարումը շարունակելու համար կենսաթոշակառուն պարտավոր է տարեկան առնվազն 1 անգամ, վերջին անգամ բանկ ներկայանալու (կենսաթոշակն անկանխիկ եղանակով ստանալու համար դիմելու) ամսվան հաջորդող 12-րդ ամսվա վերջին աշխատանքային օրվանից ոչ ուշ, ներկայանալ բանկ և հայտարարություն ստորագրել Հայաստանի Հանրապետությունում լինելու մասին: Օրենքը հնարավորություն է ընդձեռում, որ կենսաթոշակը նաև վճարվում է կենսաթոշակառուի տված և նոտարի վավերացրած լիազորագրով, սակայն կենսաթոշակը լիազորագրով անընդմեջ կարող է վճարվել 12 ամսից ոչ ավելի ժամանակահատվածում։

Մինչդեռ, օրենքը չի նախատեսում բաց թողնված ժամկետը հարգելի համարելու հնարավորություն:

Մարդու իրավունքների պաշտպանին տարեցտարի հասցեագրվող դիմում-բողոքների աճը վկայում է, որ խնդիրն արդիական է։ Օրինակ, դիմումներից մեկով քաղաքացին հայտնել է, որ 10 տարուց ավելի երկարատև բուժման հիմքով Հայաստան չի վերադարձել, ինչը մեխանիկորեն հանգեցրել է կենսաթոշակի վճարման դադարեցման:

Պաշտպանի աշխատակազմի հարցումը ՀՀ աշխատանքի և սոցիալական հարցերի նախարարություն ցույց է տալիս, որ 2019 թվականին սահմանված ժամկետում հայտարարությունը չստորագրելու հիմքով դադարեցվել է թվով 40314 անձանց կենսաթոշակի (նպաստի) վճարում, որից 5200 անձանց կենսաթոշակի (նպաստի) վճարումը չի վերսկսվել:

Մարդու իրավունքների պաշտպանի աշխատակազմում թեմայի վերաբերյալ իրականացվել է միջազգային փորձի և ներպետական օրենսդրության ուսումնասիրություն։

Այսպիսով, Պաշտպանի դիրքորոշմամբ՝ կենսաթոշակի նշանակման պահից կենսաթոշակառուին տրամադրման ենթակա գումարները հանդիսանում են իր սեփականությունը, հետևաբար, վերջինս ունի այդ գումարներն իր հայեցողությամբ օգտագործելու, տիրապետելու և տնօրինելու իրավունք: Իսկ տարեկան առնվազն 1 անգամ բանկ չներկայանալու փաստը չի ենթադրում, որ կենսաթոշակառուն սեփականության իրավունքով իրեն պատկանող դրամական միջոցներից հրաժարվելուն ուղղված որևէ գործողություն է կատարել:

Պաշտպանն առաջարկել է «Պետական կենսաթոշակների մասին» ՀՀ օրենքում կատարել փոփոխություններ, որով կամրագրվի բաց թողնված ժամկետը հարգելի համարելու հնարավորությունը:
