ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ՀՀ պետական գույքի կառավարման կոմիտեից ստացված փաստաթղթերի հիման վրա կատարված ուսումնասիրությամբ պարզվել է, որ 80% պետական բաժնեմասով «Երևանի ոսկերչական գործարան» ԲԲ ընկերությունը 2017թ.-ի մայիսի 12-ին հայցադիմում է ներկայացրել Երևան քաղաքի Կենտրոն և Նորք-Մարաշ վարչական շրջանների ընդհանուր իրավասության առաջին ատյանի դատարան և խնդրել է անվավեր ճանաչել «N» ԲԲ ընկերության հետ 2016թ. դեկտեմբերի 5-ին կնքած «փոխադարձ հաշվարկների ստուգման ակտերն», ինչպես նաև վերջինից բռնագանձել 1.092.593.543 ՀՀ դրամ:

Դատարանը 2018թ.-ի հուլիսի 27-ի վճռով մերժել է ընկերության պահանջը` պատճառաբանելով, որ «փոխադարձ հաշվարկների ստուգման ակտերի» հիմք են հանդիսացել կողմերի միջև կնքված պայմանագրերը, սակայն հայցվորը դատարան չի ներկայացրել վկայակոչած պայմանագրերը և չի ապացուցել պայմանագրային հարաբերությունների մեջ գտնվելու հանգամանքը: ՀՀ վերաքննիչ քաղաքացիական դատարանը 2018թ.-ի հոկտեմբերի 25-ի որոշմամբ վճիռը թողել է անփոփոխ, իսկ ՀՀ վճռաբեկ դատարանը տնօրենի ժամանակավոր պաշտոնակատարի բերած վճռաբեկ բողոքը 2018թ.-ի դեկտեմբերի 12-ի որոշմամբ թողել է առանց քննության:

Մինչդեռ, Պետական գույքի կառավարման կոմիտեից ստացված գրության և կից ներկայացված փաստաթղթերի ուսումնասիրությամբ պարզվել է, որ թեև համագործակցության պայմանագիր և հետագայում նաև պայմանագրի ժամկետները երկարաձգելու վերաբերյալ համաձայնագրեր կնքվել են, դրանք առկա են եղել ընկերությունում, սակայն չեն ներկայացվել դատարանի գնահատմանը, ինչն էլ հիմք է հանդիսացել հայցը մերժելու համար:

Բացի այդ, պարզվել է նաև, որ վճռաբեկ բողոքն առանց քննության թողնելու հիմք է հանդիսացել այն հանգամանքը, որ բողոք բերած անձը վճռաբեկ բողոքում չի նշել վճռաբեկ բողոքը վարույթ ընդունելու հիմքը և դրա հիմնավորումը, ինչպես նաև ներկայացրել է պետական տուրքի վճարումը հետաձգելու մասին միջնորդություն, սակայն չի ներկայացրել գույքային դրության վերաբերյալ ապացույցներ:

Այսինքն՝ «Երևանի ոսկերչական գործարան» ԲԲ ընկերության պատասխանատու պաշտոնատար անձինք վկայակոչված քաղաքացիական գործի շրջանակներում օժտված լինելով դատարանի կողմից բաշխված բեռի ապացուցման պարտականությամբ, 2017-2018թթ. դատարան չեն ներկայացրել «փոխադարձ հաշվարկների ստուգման ակտերի» հիմք հանդիսացող պայմանագիրը, ինչպես նաև չեն շտկել վճռաբեկ դատարանի կողմից արձանագրված թերությունները: Դրա հետևանքով պետական բաժնեմասով ընկերությունը ոչ միայն զրկվել է 1.092.593.543 ՀՀ դրամ դեբիտորական պարտքը ստանալու հնարավորությունից, այլև ծանրաբեռնվել է նաև շուրջ 56.000.000 ՀՀ դրամ պետական տուրք վճարելու պարտավորությամբ:

Նկատի ունենալով, որ ուսումնասիրությամբ ի հայտ են բերվել պաշտոնատար անձի կողմից ծառայության նկատմամբ անբարեխիղճ կամ անփույթ վերաբերմունքի հետևանքով իր պարտականությունները չկատարելու կամ ոչ պատշաճ կատարելու, դրա հետևանքով անզգուշությամբ ծանր հետևանքներ առաջանալու հանցավոր արարքի առերևույթ կատարման հատկանիշներ պարունակող տվյալներ՝ ՀՀ գլխավոր դատախազության պետական շահերի պաշտպանության վարչությունում ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 2-րդ մասով հարուցվել է քրեական գործ:

Նախաքննություն կատարելու հանձնարարությամբ քրեական գործն ուղարկվել է ՀՀ քննչական կոմիտե:
