ՀՀ քննչական կոմիտեի Երևան քաղաքի քննչական վարչության Աջափնյակ և Դավթաշեն վարչական շրջանների քննչական բաժնում քննվող քրեական գործով իրականացված քննչական և դատավարական գործողությունների արդյունքում պարզվել են բազմաբնակարան շենքերի կառուցմամբ զբաղվող ԲԲ ընկերության տնօրենի և նրա ծանոթի կողմից առանձնապես խոշոր չափերով խարդախություն կատարելու դեպքի մի շարք հանգամանքներ:

Քննությամբ ձեռք բերված տվյալների համաձայն՝ վերոնշյալ ընկերության տնօրենը, որը 2011թ. Երևան քաղաքի Ֆուչիկ փողոցում սկսել էր բազմաբնակարան շենքերի կառուցումը, շենքերի ընդհանուր 250-270 քմ. մակերեսով եվրոպատուհանները տեղադրելու հարցում պայմանավորվածություն է ձեռք բերել եվրոպատուհանների արտադրությամբ և տեղադրմամբ զբաղվող ՍՊ ընկերության տնօրենի հետ, որի հետ ծանոթացել էր իր ծանոթի՝ Երևանի 34-ամյա բնակչի հետ, որը միևնույն ժամանակ հանդիսանում է ՍՊ ընկերության տնօրենի որդու մտերիմ ընկերը:

Պայմանավորվածության արդյունքում ՍՊ ընկերության աշխատակիցների կողմից կատարվել է ընդհանուր 25.000 ԱՄՆ դոլար արժողությամբ պատուհանների տեղադրումը, սակայն ԲԲ ընկերության տնօրենը, չկարողանալով կանխիկ վճարել մատուցված ծառայությունների դիմաց, 2016թ. ապրիլից շինարարական աշխատանքները դադարեցնելուց հետո, 34-ամյա ծանոթի հետ, խմբի կազմում, ՍՊ ընկերության տնօրենից առանձնապես խոշոր չափերի գումարը խարդախությամբ հափշտակելու և վաճառքի ենթակա բնակարանը 34-ամյա տղամարդու անվամբ ձևակերպելու դիտավորությամբ, պայմանավորվածություն է ձեռք բերել՝ հավելյալ 20.000 ԱՄՆ դոլար վճարի դիմաց Ֆուչիկի փողոցում գտնվող կիսակառույց շենքերից մեկում նրան տրամադրել 21.687.300 ՀՀ դրամին համարժեք 45.000 ԱՄՆ դոլար արժողությամբ բնակարան:

Պայմանավորվածության համաձայն՝ 2016թ-ի ապրիլի 5-ին ԲԲ ընկերության տնօրենի և ՍՊ ընկերության տնօրենի կնոջ միջև կնքվել է առուվաճառքի նախնական պայմանգիր, որից անմիջապես հետո իր գրասենյակում ԲԲ ընկերության տնօրենը ՍՊ ընկերության տնօրենից առձեռն ստացել է 9.638.800 ՀՀ դրամին համարժեք 20.000 ԱՄՆ դոլարը` պարտավորվելով մինչև նույն թվականի մայիսի 31-ը տրամադրել բնակարանի սեփականության իրավունքի վկայականը:

Շարունակելով իրենց հանցավոր մտադրությունը` 2016թ. ապրիլից մինչև 2018թ. մայիսն ընկած ժամանակահատվածում տարբեր պատճառաբանություններով ձգձգելով սեփականության իրավունքի վկայականի տրամադրումը, բնակարանի ներքին հարդարման աշխատանքները կատարելու պատրվակով ԲԲ ընկերության տնօրենը և ծանոթը ՍՊ ընկերության տնօրենից պահանջել և մաս-մաս ստացել են ևս 12.000 ԱՄՆ դոլար գումար: Այնուհետև 34-ամյա տղամարդու կողմից անձամբ բնակարանի սեփականաշնորհմամբ զբաղվելու պատրվակով վերջինիս միջոցով վերցրել են առուվաճառքի նախնական պայմանագրի բնօրինակը` ՍՊ ընկերության տնօրենին և կնոջը զրկելով բնակարանը ձեռք բերելու հնարավորությունից, որը շուկայականից անհամեմատ էժան գնով` 4.443.410.00 ՀՀ դրամով, 2019թ. հոկտեմբերի 9-ին գնվել է 34-ամյա տղամարդու կողմից՝ ամուսիններին պատճառելով առանձնապես խոշոր չափերի գույքային վնաս:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ բազմաբնակարան շենքերի կառուցմամբ զբաղվող ԲԲ ընկերության տնօրենին և նրա 34-ամյա ծանոթին մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 178-րդ հոդվածի (խարդախություն) 3-րդ մասի 1-ին կետով: Նրանց նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն չհեռանալու մասին:
